ITEM NO. 12:  COMPREHENSIVE PLAN AMENDMENT TO HORIZON 2020 CHAPTER 14 – SPECIFIC PLANS, SOUTHEAST AREA PLAN (MJL)

 

CPA-2008-1:  Amend the Southeast Area Plan, Recommendations section; Land Use, Land Use Descriptions, Commercial Zoning Districts  to change CC400 District to CC200 District.

 

STAFF RECOMMENDATION:  Staff recommends approval of the amendment to Horizon 2020, to change Chapter 14 – Specific Plan, Southeast Area Plan section 3.11 Commercial, Zoning Districts to change the CC400 District to the CC200 District.

 

STAFF REVIEW AND SUMMARY

This comprehensive plan amendment is an amendment of the Southeast Area Plan.  During the implementation of the Southeast Area Plan, it was noticed that in the recommendation section, under commercial land use descriptions; zoning districts, it is stated that a CC400 District zoning would be recommended for the commercial center at the southern portion of the intersection of W. 23rd Street and O’Connell Road.  It was not the intention to allow for a commercial district of this size to be located within the Southeast Area Plan planning area nor does the designation meet the commercial locational criteria outlined in Horizon 2020 for CC400 commercial center.  The intent was to identify the CC200 District for a possible zoning district designation and for the identified district to be a CC200 commercial center.  The designation for the commercial center at W. 23rd Street and O’Connell Road has already been approved to change from a neighborhood commercial center to a CC200 commercial center in Chapter 6 – Commercial Land Use as part of the Southeast Area Plan implementation process.  This correction would make the Southeast Area Plan consistent with Horizon 2020.  The change is demonstrated below with the excerpt out of the Southeast Area Plan.

 

Commercial:

The intent of the commercial use is to allow for retail and service uses.  A Community Commercial Center provides goods and services to several different neighborhood areas.  A Neighborhood Commercial Center provides for the sale of goods and services at the neighborhood level.

Intensity:  Medium-High

Applicable Areas:

·         Area southeast of the intersection of E. 23rd Street/K-10 Highway and O’Connell Road. (Community Commercial Center)

·         Area northeast of the intersection of Franklin Road extended and E. 28th Street extended.  (Neighborhood Commercial Center)

Zoning Districts:  CC400 CC200 (Community Commercial District), CN2 (Neighborhood Commercial Center District), PD (Planned Development Overlay) Primary Uses:  Civic and public uses, medical facilities, eating and drinking establishments, general office, retail sales and services, fuel sales, car wash

 

 

 

 

COMPREHENSIVE PLAN AMENDMENT REVIEW

 

A.        Does the proposed amendment result from changed circumstances or unforeseen conditions not understood or addressed at the time the plan was adopted?

This amendment is to correct an error that was noticed during the implementation of the plan. 

 

B.        Does the proposed amendment advance a clear public purpose and is it consistent with the long-range goals and policies of the plan?

This amendment, if left as is, would not be consistent with other chapters of Horizon 2020.  The locational criteria for a CC400 commercial center could not be met within the Southeast Area Plan planning area.  By changing the recommended zoning designation from the CC400 District to the CC200 District, the plan would then be consistent with Horizon 2020.

 

C.        Is the proposed amendment a result of a clear change in public policy?

The proposed change is a clear change in public policy because the governing bodies approved and amended the Southeast Area Plan into the comprehensive plan.  Also, approvals of the recommended implementation of the Southeast Area Plan have been approved which designated the W. 23rd Street and O’Connell Road intersection as a CC200 commercial center.  An error was found during the implementation of the plan offering the CC400 District as an option for zoning designations and in order to make the plan consistent with Horizon 2020 it needs to be changed to the CC200 District.

 

 

PROFESSIONAL STAFF RECOMMENDATION

Staff recommends:

1.      approval of the amendment to Horizon 2020, to change Chapter 14 – Specific Plan, Southeast Area Plan, section 3.11 Commercial, Zoning Districts to change the CC400 District to the CC200 District and forwarding the recommendation for approval to the governing bodies for concurrence, and

2.      authorize the chair to sign PC Resolution 2008-05.
