RE:	Agreement With Alcott L.C. Related to Improvements to 19^th Street (Ohio to Alabama Streets), Project No. 61-GI2-1104(C)

Project Details:

The City Commission previously authorized geometric improvements on 19^th Street between Ohio Street and Alabama Street. The specific improvements and project funding information are set forth in the attached staff memorandum. The project is underway with completion slated to occur before classes resume for USD 497 in August 2008.

The agreement with Alcott L.C., owner of the Laundromat located at the intersection of 19^th and Louisiana, provides for improvements to the business’s parking lot and sidewalk. The Owner agrees to donate an easement in the southeast corner of the property for an existing sanitary sewer line and City sidewalk not currently located in the City’s right of way. The agreement acknowledges that access to the Laundromat building from 19^th Street has occurred for many years and there are no plans to alter that access and use at this time. Further, the owner agrees to execute a release waiving any claims against the City related to the public improvement project and the construction of the improvements on the Owner’s property, including claims for loss of business or claims of inverse condemnation. The cost of the improvements set forth in the agreement with Alcott L.C. will be approximately $29,000.00 and will be paid for from remaining project funds and utility funds. The work will be performed by the City’s contractor, LRM, or its subcontractors as part of the 19^th Street improvement project.

Action Requested

Staff requests the City Commission authorize the City Manager to execute the agreement with Alcott, L.C.
