RESOLUTION NO.  6769

 

A RESOLUTION ESTABLISHING A POLICY OF THE CITY OF LAWRENCE, KANSAS TO PROVIDE ASSISTANCE TO OTHER JURISDICTIONS DURING TIMES OF DISASTER.

 

WHEREAS, the City of Lawrence, Kansas, includes "public safety agencies'' as that term is defined in K.S.A. 12-16,117; and

 

WHEREAS, the Governing Body of the City of Lawrence desires, whenever it is reasonable to do so, to render assistance during times of disaster to other governing bodies and jurisdictions that request such assistance.

 

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS:

 

Section One:  The terms used in this resolution have the meanings ascribed to them by K.S.A. 12-16,117, and amendments thereto.

 

Section Two:  In the event of a disaster either within or without the State of Kansas, and upon a request for assistance from another municipality or public safety agency, the City Manager or his or her designee, in that person’s discretion, is hereby authorized to provide such assistance from the City’s public safety agencies that the City is able to provide without unduly jeopardizing the protection of the City of Lawrence.

 

Section Three:  Nothing in this Resolution is intended to conflict or circumvent any existing interlocal agreement, local or interjurisdictional disaster plan adopted pursuant to K.S.A. 48-901 et. seq. and amendments thereto, or any automatic aid, intergovernmental or mutual aid agreement, or any authority to enter into those in the future.

 

Section Four:  A copy of this resolution shall be filed with the emergency preparedness officer of Douglas County, Kansas, and shall also be filed with the Division of Emergency Preparedness as part of the local or interjurisdictional disaster plan required pursuant to K.S.A. 48-929, and amendments thereto.

 

Section Five:  All assistance provided pursuant to this Resolution shall be provided subject to the privileges and immunities set forth in K.S.A. 12-16,117.

 

Section Six:  This Resolution shall become effective upon adoption and filing with the Douglas County Emergency Preparedness Officer, and shall be in force until repealed or rescinded.
