RE:	Oread Inn - Vacation Request and Indiana Street closure request Vacation of the Right-of-Way on the East Side of Indiana Street May 20, 2008 Regular Agenda Item

Please include the following item on the City Commission regular agenda for consideration at the May 20, 2008 meeting:

The Oread Inn project has begun excavation for the underground parking structure. The excavation has created some challenges; namely, traffic control around the site, and the limited/tight boundaries of the site for construction activities.

Attached is a new traffic control plan which would close Indiana Street between 11^th Street and 12^th Street for several months pending completion of the underground parking structure. Before this occurs, the neighborhood needs to be notified and there should be discussion with emergency services. A meeting with the KU Bus Service is scheduled for Thursday, May 15, 2008, to discuss impacts.

Additionally, the development is requesting the City to consider vacating three feet of Indiana Street. The vacation would allow the entire building to shift three feet to the west so the east edge of the property could be safely shored during excavation and construction of the underground parking structure. There are no other changes to the structure’s size or height – just a shifting of the location three feet to the west.

The vacation process will require a twenty day publication and notice period. The development/project is under way and would like to close Indiana Street by the first of June.

Action Requested: Receive request for vacation of right-of-way on the east side of Indiana, and new traffic control plan. Provide direction to staff.
