Call
meeting to order.
Dillon called the meeting to order at 6:30
p.m.
Introductions.
Approve the September 19,
2007 minutes.
Breithaupt made
a motion to approve the minutes. Hoag second
the motion, the motion passed 4-0.
Hear
request to repeal section 5-504.8 of the City Code.
Dillon turned the floor over to White for a power
point presentation on Studor brand air admittance valves. White explained that
the developer involved with the Oread Hotel project was interested in using
Studor air admittance valves on their project and they were there to appeal to
the Board.
White’s presentation detailed the manufacturer’s
requirements, example applications, video demonstration of the Studor products,
and the standards to which the products are tested.
White pointed out several benefits of using air
admittance valves. As one example White sited less structural damage as a
result from less vent pipe. White mentioned there would also be an economic
benefit.
Werner projected that there could be up to a two
hundred and fifty thousand dollar savings and stressed to the Board that his
company was not interested in recommending an unproven product.
White
concluded his presentation and asked if there were any questions.
Breithaupt
asked what the life expectancy was for the product. White responded that the
warranty would be for the life of the structure.
Carpenter
stated that he did not have a problem with the devises but his concern was if
the devise malfunctioned or was damaged that maintenance people may not replace
the product properly. Carpenter continued saying he was inclined to allow the
use of air admittance valves on a project like the Oread Hotel.
Staff
stated that the current issues raised did not warrant the restriction in the
ordinance and recommended that the Board look at deleting the section 5-504.8.
Hoag
agreed with staff’s assessment.
Carpenter
stated that deleting the section would allow it in a triplex but it would not
be allowed in a duplex. Carpenter added that he would like to have the
ordinance continue to restrict the use from multifamily occupancies.
Dillon
made a motion to delete section 5-504.8.
Hoag second the motion, the motion
passed 3-1 with Carpenter the no vote.
Breithaupt
spoke up and asked to change his vote. Breithaupt said that he thought the
hotel should be allowed to use air admittance valves but did not to make that
decision. Breithaupt continued saying that if denied the appellant would go to
the Commission and get it approved. Breithaupt then asked why Carpenter was
against the use of air admittance valves.
Carpenter
replied that he did not have an issue with air admittance valves being used on
the hotel project. Carpenter explained that it was being able to use them in multifamily
applications such as a triplex that was his concern. Carpenter suggested
allowing the use in building over three stories in height.
Breithaupt
asked that since the Board voted to delete the amendment for the International
Plumbing Code did the Board have to delete the amendment for the International
Residential Code.
Staff
stated that it was not necessary for the Board to change the corresponding ordinance
relevant to the International Residential Code. Staff reminded the Board that a
motion to delete the amendment was approved and if the Board wished to go a
different direction the motion to delete would need to be addressed.
Carpenter
stated that it would not be right to allow the use in a triplex and restrict
the use in a duplex. Carpenter continued saying that if the Board was going to
allow the use of air admittance valves they needed to allow it through out the
codes or put a floor height restriction on the use.
Breithaupt
made a motion to revoke the last motion
and consider an alternative. Carpenter second
the motion, the motion passed 3-1 with Hoag the no vote.
Hoag
explained his vote stating he was in favor of removing the entire amendment.
Carpenter
made a motion to change the language of
section 5-504.8 of the City Code to allow air admittance valves in buildings
four or more stories in height. Breithaupt second the motion, the motion passed 4-0.
Adjourn
With no other business a motion was made by Hoag
to adjourn the meeting, Carpenter second the motion, the motion passed 4-0.
Dillon adjourned the
meeting at 8:40 p.m.
