Right-of-way encroachment license agreement for Virginia Inn, Inc. Addition located at 2907 W 6th Street

 

 

 

 

                                               

A final plat [PF-11-30-06; Virginia Inn, Inc. Addition] was submitted to replat the property located at 2907 W 6th Street in November of 2006. The City Commission approved the plat on January 02, 2007 with conditions of approval.  One of the conditions was that the property owner execute a right-of-way encroachment agreement with the City for the parking area in the northwest corner. 

 

The parking area in the northwest corner, shown on Exhibit A of the right-of-way license agreement, was adjacent to the right-of-way line prior to the replat.  As inadequate right-of-way existed along W 6th Street, an additional 5’ of right-of-way was required to be dedicated with the plat. The dedication of this additional right-of-way resulted in the northern portion of the parking area being within the right-of-way.
