RE:

Ordinance No. 8255 –Amending the Subdivision Regulations for Lawrence and the Unincorporated Areas of Douglas County by incorporating by reference the “Subdivision Regulations for Lawrence and the Unincorporated Areas of Douglas County, Kansas March 25, 2008 Text Amendments.” 

 

Proposed Ordinance No. 8255 incorporates by reference text amendments to the joint “Subdivision Regulations for Lawrence and the Unincorporated Areas of Douglas County, Kansas December 19, 2006 Edition.”  These amendments approved by the City Commission on March 25, 2008 (TA-09-21A-07 to TA-09-21D-07) pertaining to road construction standards and the type of road (i.e. hard-surface vs. County’s Rock Road Standard) from which a property created by a division under the Subdivision Regulations may take access.  The Board of County Commissioners approved this text amendment on November 14, 2007. 

 

Pursuant to K.S.A. 12-3009 et seq., K.S.A. 12-3301 et seq. and the Home Rule Authority of the City as granted by Article 12, § 5 of the Kansas Constitution, the City of Lawrence is authorized to adopt by ordinance and by incorporation by reference, any standard or model code or ordinance, regulation having the effect of law of a state officer, board or other agency, or statute, or portions thereof on any subject on which a city may legislate, which standard or model code or ordinance or state regulation is available in book or pamphlet form. 

 

The “Subdivision Regulations for Lawrence and Unincorporated Douglas County, March 25, 2008 Text Amendments” contains all of the approved text amendments and is attached for reference purposes. 

 

Action Requested: Staff recommends adopting proposed Ordinance No. 8255.
