RE:

Ordinance Nos. 8258 and 8259 Concerning Deferral of Special Assessments for East Hills Business Park

On March 11, 2008, the City Commission received a staff report on a request from Douglas County regarding the special assessments for public improvements levied against lots, pieces and parcels of land in the East Hills Business Park Improvement District.  After considering several options related to the deferred special assessments, the City Commission directed staff to work with Douglas County to amend the interlocal agreement to allow the deferral to continue for an additional five-year period, through May 2014.

A Second Amendment to Interlocal Agreement and Guarantee and Reimbursement Agreement at East Hills Business Park (attached) has been prepared extending the deferral period an additional five (5) years.  In Paragraph Seven of the Second Amendment, the City agrees to adopt the necessary ordinances to extend the maximum term of the deferral of the Assessments.  Attached please find Ordinance No. 8258 and Ordinance No. 8259 extending the deferral period for the Douglas County properties in East Hills Business Park for an additional five years.  Staff recommends adoption of Ordinance Nos. 8258 and 8259, as appropriate.
