WORK ORDER NO. 2008-1 TO

OPEN AGREEMENT BETWEEN SPONSOR AND CONSULTANT

FOR

PROFESSIONAL SERVICES

This is an addition to an agreement made by and between CITY OF LAWRENCE (SPONSOR), 6 East 6th, Lawrence, Kansas 66044, and AIRPORT DEVELOPMENT GROUP, INC. (CONSULTANT), 1776 S. Jackson Street, Suite 950, Denver, Colorado 80210.

WITNESSETH:

WHEREAS, SPONSOR and CONSULTANT have heretofore entered into an agreement between themselves for open consulting services, and

WHEREAS, parties hereto do now desire to add certain work items to said agreement dated ______________, 2008, between themselves, and to reduce said work to written work order;

NOW, THEREFORE, in consideration of the original agreement between the parties, the premises hereto, the mutual covenants, promises, doings and things hereinafter set forth, the parties hereto do now agree as follows:

Work ItemsLand Acquisition Assistance Services for the following items to be in conjunction with the AIP 3-20-0047-15 project:

 

Complete EA and Acquire Land Parcels Associated with Runway 1-19

 

The following are added to the Open Agreement for this work item only:

SECTION 1 - Basic Services

1.3        Complete an Environmental Assessment

CONSULTANT shall complete an Environmental Assessment as per FAA’s Handout “ENVIRONMENTAL ASSESSMENT (EA) FOR LAND ACQUISITION (Revision No. 1 – May 2007)”, which is attached hereto as Attachment “A”.  

 

1.4        Land Acquisition Assistance

Assist the SPONSOR in acquiring the land necessary for future airport development. Such assistance shall include the obtaining of legal descriptions through surveys, coordination with the register of deeds and/or abstract office, obtaining qualified appraisers to complete satisfactory appraisals and review appraisals, and informing land owners of the requirements and regulations to be followed in the process of acquiring the land. CONSULTANT will make the offers on behalf of the SPONSOR in the making of offers and coordination with legal counsel to purchase and/or take the land by eminent domain.  Survey costs and appraisers will be contracted directly to and paid by the CONSULTANT but coordinated with the SPONSOR. Although no permits are anticipated, any permits shall the responsibility of the CONSULTANT.

 

1.3.1. Upon completion of the project, the CONSULTANT shall prepare the revised Exhibit A Property Map showing the land acquired, and the final report and shall provide the SPONSOR with one set of reproducible drawings together with one copy of the drawings for the FAA.

 

 

SECTION 5 ‑ PAYMENTS TO CONSULTANT

5.1        Methods of payment for services and expenses of CONSULTANT.

5.1.1.    For Basic Services. SPONSOR shall pay CONSULTANT for basic services rendered under Section 1 as follows:

5.1.1.1. Amount of payment for Basic Services: A not to exceed fee of $40,000 based upon hourly rates set forth in the open agreement.

5.1.1.2. Times of payment.

The basic service fees will be invoiced on a monthly basis as work progresses.
