RE:	234 N. 8^th Street Lease Agreement

In 2003, the City Commission authorized the lease of a City owned vacant lot at 234 N. 8^th Street in North Lawrence to the adjacent property owners for a nominal annual rent of $100. In exchange for the use of the City’s lot, the adjacent property owners agreed to keep it mowed and maintained. The lease was offered to a successor property owner in September 2004 (234 N. 8^th Lease). This property owner recently sold their property (228 North 8^th) which is located adjacent to the vacant lot at 234 N. 8^th Street. The new owners, Gary and Jan Unfred, have requested to lease the City owned lot on the same terms as previous lease arrangements (Unfred request). This property was originally purchased by the City as part of a stormwater mitigation buyout. Leasing of the vacant lot will save the City from mowing and maintenance expense. The lease is for an initial term of (5) years and will expire December 31, 2013.

ACTION:

Authorize the City Manager to execute a lease for City owned property at 234 N. 8^th Street to Gary D. and Jan Unfred. Lease Agreement
