ORDINANCE NO.  8194

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, ANNEXING PROPERTY PURSUANT TO K.S.A. 12-519 ET SEQ.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The Governing Body finds that the tracts of property described in Section II of this ordinance, hereby incorporated by reference as if fully described, adjoins the boundaries of the City of Lawrence, Kansas.  The Governing Body further finds that a petition and consent to annex into the City of Lawrence, Kansas was submitted for the property described in Section II.  The property is generally located west of Folks Road and south of N 1700 Rd. (Peterson Road extended) and is commonly known as Bauer Brook Estates. 

 

SECTION II.  The following described tracts of property are hereby annexed into the City of Lawrence, Kansas pursuant to K.S.A. 12-519 et seq., to-wit:

 

THE NORTHEAST QUARTER OF SECTION 28, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHEAST CORNER OF THE NORTHEAST QUARTER OF SAID SECTION 28; THENCE SOUTH 88°09’19”  WEST ALONG THE NORTH LINE OF SAID NORTHEAST QUARTER A DISTANCE OF 40.00 FEET; THENCE SOUTH 01°48’13” EAST PARALLEL TO THE EAST LINE OF SAID NORTHEAST QUARTER 12.5 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE SOUTH 01°48’13” EAST A DISTANCE OF 2,639.26 FEET TO THE SOUTH LINE OF SAID NORTHEAST QUARTER; THENCE SOUTH 88°12’49” WEST ALONG THE SOUTH LINE OF SAID QUARTER, 2,627.92 FEET TO THE SOUTHWEST CORNER OF SAID QUARTER; THENCE NORTH 01°52’33” WEST ALONG THE WEST LINE OF SAID QUARTER, 2,649.08 FEET TO THE NORTHWEST CORNER OF SAID QUARTER; THENCE NORTH 88°09’19” EAST 2,011.26 FEET THENCE SOUTH 01°48’13” WEST. 12.50 FEET THENCE NORTH 88°09’19” EAST, 620 FEET TO THE POINT OF BEGINNING, CONTAINING 161.019 ACRES MORE OR LESS, ALL IN DOUGLAS COUNTY. KANSAS.  THE ABOVE SAID AREA HAS BEEN PLATTED AS BAUER BROOK ESTATES, A SUBDIVISION OF DOUGLAS COUNTY, KANSAS RECORDED IN PLAT BOOK P17, PAGE 82 WITH THE DOUGLAS COUNTY REGISTER OF DEEDS.

 

LESS THAT TRACT ANNEXED BY ORDINANCE NO. 7246 DESCRIBED AS TRACT A IN BLOCK 1, BAUER BROOK ESTATES.

 

ALSO:

 

DESCRIPTION FOR THE ANNEXATION OF THE FOLKS ROAD (COUNTY ROAD #6) RIGHT-OF-WAY ADJACENT TO BAUER BROOK ESTATES IN THE NORTHEAST QUARTER OF SECTION 28, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHEAST CORNER OF THE NORTHEAST QUARTER (NE ¼) OF SAID SECTION 28; THENCE SOUTH 88°09’19”  WEST ON THE NORTH LINE OF THE NORTHEAST QUARTER (NE ¼) OF SAID SECTION 28 A DISTANCE OF 40.00 FEET; THENCE SOUTH 01°48’13” EAST PARALLEL TO THE EAST LINE OF THE NORTHEAST QUARTER (NE ¼) OF SAID SECTION 28 A DISTANCE OF 12.5 FEET TO THE NORTHEAST CORNER OF TRACT A, BLOCK  1 BAUER BROOK ESTATES FOR  A  POINT OF BEGINNING; THENCE CONTINUING SOUTH 01°48’13” EAST A DISTANCE OF 2639.25 FEET TO THE SOUTHEAST CORNER OF LOT 7 BLOCK 1 BAUER BROOK ESTATES; THENCE NORTH 88°12’49” EAST A DISTANCE OF 40.00 FEET TO THE SOUTHEAST CORNER OF THE NORTHEAST QUARTER (NE ¼) OF SAID SECTON 28; THENCE NORTH 01°48’13” WEST ON THE EAST LINE OF THE NORTHEAST QUARTER (NE ¼) OF SAID SECTION 28, A DISTANCE OF 2639.30 FEET;  THENCE SOUTH 88°09’19” WEST A DISTANCE OF 40.00 FEET TO THE POINT OF BEGINNING, CONTAINING 105571.16 SQUARE FEET MORE OR LESS, ALL IN DOUGLAS COUNTY. KANSAS.  SUBJECT TO RIGHTS-OF-WAY, EASEMENTS AND RESTRICTIONS OF RECORD

 

 

SECTION III.  The City Commission hereby authorizes the City Manager to enter into annexation agreements with owners of property annexed in Section II, to maintain ownership of animals after annexation into the corporate limits of the City.

 

SECTION IV.  The City Commission hereby authorizes the City Manager to enter into annexation agreements with owners of property annexed in Section II, to permit construction commenced on or before December 31, 2008, of detached ancillary buildings in compliance with Douglas County Building and Development Code Regulations.

 

SECTION V.  SEVERABILITY.  If any section, clause, sentence, or phrase of this ordinance  is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of the of this ordinance. 

 

 

SECTION VI.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
