ORDINANCE NO. 8231

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS ANNEXING PROPERTY PURSUANT TO K.S.A.12-520 ET SEQ.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

Section 1.  The Governing Body finds that the tract of property described in Section II of this ordinance, hereby incorporated by reference as if fully described, adjoins the boundaries of the City of Lawrence, Kansas.  The Governing Body of the City of Lawrence, Kansas is the owner of the tract and consents to the annexation.   The property is generally located north of Folks Road extended and south of Interstate 70. The Lawrence-Douglas County Planning Commission recommended annexation of said property on May 21, 2007. The City Commission voted to approve the annexation on ______________________, 2008

 

Section 2.  The following described tract of property is hereby annexed into the City of Lawrence, Kansas pursuant to K.S.A. 12-520 et seq., to-wit:

 

Annexation of City Property in the Northeast Quarter of Section 21, Township 12 South, Range 19 East.

     Beginning at the Southeast corner of the Northeast Quarter (NE ¼) of Section 21, Township 12 South, Range 19 East of the Sixth Principal Meridian in, Douglas County, Kansas; thence South 88°11'08" West on the South line of the Northeast Quarter (NE ¼) of said Section 21 a distance of 40.00 feet to the Westerly Right-of-way line of Douglas County Road No. 540; thence North 01°33'31" West on the Westerly Right-of-way line of Douglas County Road No. 540 a distance of 704.50 feet; thence North 22°01'29" East on the Westerly Right-of-way line of Douglas County Road No. 540 a distance of 94.56 feet; thence South 88°11'08" West a distance of 547.83 feet; thence South 01°33'31" East a distance of 791.00 feet to the South line of the Northeast Quarter (NE ¼) of said Section 21; thence South 88°11'08" West on the South line of the Northeast Quarter (NE ¼) of said Section 21, a distance of 777.74 feet to the Southwest corner of the East One-half (E ½) of the Northeast Quarter (NE ¼) of said Section 21; thence North 01°42'52" West on the West line of the East One-half (E ½) of Northeast Quarter (NE ¼) of said Section 21 a distance of 1465.56 feet to the South Right-of-way line of The Kansas Turnpike Authority; thence North 89°07'42" East on the South Right-of-way line of the Kansas Turnpike Authority a distance of 1331.81 feet to the East line of the Northeast Quarter  (NE ¼) of said Section 21 and the West line of the Northwest Quarter (NW ¼) of Section 22 Township 12 South, Range 19 East of the Sixth Principal Meridian; thence continuing North 89°07'42" East on the South Right-of-way line of the Kansas Turnpike Authority a distance of 1809.94 feet to a Point of Curvature; thence continuing on the South Right-of-way line of the Kansas Turnpike Authority on a Curve to the Right with a Radius of 7489.43 feet an Arc length of 837.62 feet to the East line of the Northwest Quarter of said Section 22; thence South 01°50'11" East on the East line of the Northwest Quarter (NW ¼) of said Section 22, a distance of 34.70 feet to the Southeast corner of the Northwest Quarter (NW ¼) of said Section 22; thence South 88°19'38" West on the South line of the Northwest Quarter (NW ¼) of said Section 22, a distance of 2645.18 feet to the Northeast corner of the Southeast Quarter (SE ¼), of the Northeast Quarter (NE ¼) of said Section 21; thence South 01°33'31" East on the East line of the Northeast Quarter (NE ¼) of said Section 21, a distance of 1324.10 feet; to the Point of Beginning containing 40.87Acres more or less all in Douglas County, Kansas, subject to Rights-of-way, Easements, and Restrictions of Record.

 

Section 3:  Severability. If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.

 

Section 4.  This ordinance shall be in full force and take effect from and after its publication as provided by law.
