ITEM NO. 3:              ANNEXATION OF APPROX. 40 ACRES NORTH OF FOLKS ROAD EXTENDED AND SOUTH OF INTERSTATE 70 ALSO KNOWN AS PUMP STATION 48. (DDW)

 

SUMMARY

 

A-04-03-07:  Consider annexation of approximately 40 acres of land north of Folks Road extended and south of Interstate 70.  The area is known as Pump Station 48.  This action was initiated by the Lawrence City Commission on April 17, 2007.  The City of Lawrence owns the land and Pump Station #48 is located there.

 

STAFF RECOMMENDATION: 1. Forward to the Board of County Commission with a recommendation that the Board finds the annexation will not hinder ordinary growth and level of services.

2. Following the Board of County Commission’s finding, forward the annexation request to the Lawrence City Commission for approval.

3. Initiate rezoning.

 

GENERAL INFORMATION

 

Current Zoning and Land Use                    A (Agricultural) District and R-1 Single Family Residential District; Vacant.

 

Surrounding Zoning and Land Use:             A District and R-1 District to the north, west, and south; Interstate 70, agriculture, single-family residence and vacant.

 

                                                          R-1 District to the east and south; single family residence.

 

STAFF REVIEW

Annexation Procedure and General Location:

This property is owned by the City of Lawrence, who has petitioned this request for annexation.  The property is generally located north of Folks Road extended and south of Interstate 70.

 

For island annexations, Kansas Law (K.S.A. 12-520 et seq.) requires annexation by ordinance of the City Commission following a finding by the Board of County Commissioners that the annexation will not hinder the orderly growth and development of the community.  The Board of County Commissioners must approve this request before the City Commission can consider it.  Lawrence City Policy includes the Lawrence-Douglas County Planning Commission review of all annexation requests for parcels of land over ten acres is size.

 

Site Characteristics:

The subject property is located inside the Urban Growth Area (UGA) defined in Horizon 2020.  The site contains wooded areas and grassy areas.

 

Infrastructure and Utility Extension:

 

Rural Water:            The subject property is served by Rural Water District #1.

 

City Water:              The subject property is not served by City water.

 

Sewer:                    The subject property is not served by City sewer.

 

Private Utilities:         The subject property is not served by private utilities.

 

Public Right-of-Way:   The subject property is accessed by E. 1100 Rd.

 

Discussion:

The subject property is owned by the City of Lawrence.  The City Commission initiated the annexation on April 17, 2006.  The subject property is within the UGA.  The subject property is part of the property the City acquired for the Pump Station 48 project. 

 

The City recently annexed a portion of the Pump Station 48 property to facilitate construction of this new pump station to serve development north of 6th Street.  South of the subject property is the Martin Park property that is already within the City limits.  This annexation request will complete the annexation of the approximately 48 acres the City acquired for the Pump Station 48 project.

 

The annexation request does not include a rezoning request.  Staff recommends the Planning Commission initiate a rezoning from A (Agriculture) to GPI for a future public hearing.
