Acquisition –West Baldwin Creek Project |
Per your direction, property acquisition is continuing for
the West Baldwin Creek sanitary sewer improvement project. On January 29, 2008, the City Commission
authorized the completion of engineering design for the project with PEC
Engineering.
During the GMP phase of the project, engineering plans were developed to the point of providing the property acquisition team legal descriptions for the sanitary sewer and pedestrian/greenspace easements needed for the project. Negotiations have been continuing with effected property owners (see attached map for properties impacted) Project Map The acquisition amounts are based on appraisals provided by Aul & Hatfield Appraisers.
On Tract 13, the property acquisition team has reached a negotiated settlement in the amount of $21,139.00 for the required property interests. On this tract, a 3.9 acre 40’ permanent sanitary sewer easement is needed (map). Also a temporary construction easement (map) around the line alignment (3.9) acres is also required.
Additionally, the property acquisition team has acquired an 18,805 sq. ft. sanitary sewer easement that will allow the property to the west (see tract 15 below) to be able to provide sewer service for portions of this property (map). The cost of this easement, in the amount of $4,749.00 will be paid by the owner of tract 15. No sanitary sewer line will be installed in this easement with the West Baldwin Creek project, but it will be available when tract 15 is ready for development.
On Tract 15, the property acquisition team has reached a negotiated settlement in the amount of $53,000.00 for the required property interests, less the above $4,749.00 for a net amount of $48,251. On this tract, a 3.3 acre 40’ permanent sanitary sewer easement and a recreational path easement is needed (map). The recreational path component will allow for future connectivity with the existing rec path along the east side of the SLT. Also a temporary construction easement (map) around the line alignment (8.0) acres is also required. Temporary construction staging and storage areas in the amount of 5.5 acres have also been acquired (map). Finally, a sanitary sewer easement (30,996 sq. ft.) only was needed to align with the Mercato development to the south (map)
Action Requested:
Authorize the City Manager to execute purchase agreements in the following amounts:
Tract 13: $21,139.00 from Jack L. Graham, Trustee, for the above property interests.
Tract 15: $48,251.00 from SWAN Management, for the above property interests.
