ITEM NO. 1B: FINAL PLAT FOR WAKARUSA PLACE ADDITION NO. 2 (now 6WAK ADDITION); LOCATED AT THE NW CORNER OF 6TH ST & WAKARUSA DR (SMS)
PF-09-25-06: Final Plat for Wakarusa Place Addition No. 2 (now 6WAK Addition), located at the NW corner of 6th Street & Wakarusa Drive, North side of Highway 40. Submitted by BFA, Inc, for 6Wak Land Investments, LLC, and Village Meadows, LLC., property owner of record.
STAFF RECOMMENDATION: Planning staff recommends approval of the Final Plat for 6WAK Addition and forwarding it to the City Commission for acceptance of easements and rights-of-way, subject to the following conditions: 1. Provision of the following fees and documentation: a) A current copy of a paid property tax receipt. b) Recording fees made payable to the Douglas County Register of Deeds. c) A completed Master Street Tree Plan in accordance with Section 21-708a.3. d) A Temporary Utility Agreement. 2. Pinning of the lots in accordance with Section 21-302.2 of the Subdivision Regulations. 3. Submittal of Public Improvement Plans to the Public Works and Utilities Departments for street/sidewalk, stormwater, sanitary sewer, and waterline improvements. |

STAFF REVIEW
The applicant is requesting final plat approval of 6WAK Addition. The project proposal includes 127,487 square feet of commercial uses. The site is located north of W. 6th Street and west of Wakarusa Drive.
Street Right-of-Way
Wakarusa Drive and W. 6th Street are designated as principal arterials within the project vicinity. W. 6th Street includes 150 feet of right-of-way, and Wakarusa Drive includes varying right-of-way widths within the project vicinity, but maintains a minimum of 120 feet of right-of-way. As the application is being reviewed under the previous Subdivision Regulations, the existing right-of-way is sufficient. The previous Subdivision Regulations required a minimum of 120 feet of right-of-way for arterials with medians. Overland Drive and Congressional Drive are designated as collectors. Each roadway includes a minimum of 80 feet of right-of-way, which is the minimum required right-of-way for collectors under the previous Subdivision Regulations.
Sidewalks
Sidewalks exist along each roadway abutting the project boundaries. All existing sidewalks meet the minimum width requirements for sidewalks under the previous Subdivision Regulations, with the exception of the sidewalk along Wakarusa Drive. With this project, the existing 5-foot wide sidewalk along the west side of Wakarusa Drive will be reconstructed to a 10-foot wide recreation path. This pathway will serve as a southward extension of an existing 10-foot wide recreation path along the west side of Wakarusa Drive to the north of Overland Drive.
Water/Sanitary Sewer/Stormwater Services
Existing water mains are located within the right-of-way of each abutting roadway. Waterline plans will need to be submitted for review and approval from the Fire and Utilities Departments before building permits are issued.
Sanitary sewer mains exist to the west, north, and southeast of the subject property. The site’s sanitary sewer main will connect with the sanitary sewer stub located under Congressional Drive. A Downstream Sanitary Sewer Analysis has been approved by the City’s Utilities Engineer.
Stormwater mains are located in each direction of the subject property. Off-site detention will be provided on Lot 7, Block 1, 6WAK Addition. A separate site plan application has been submitted for this lot, which is zoned OS (Open Space), as this property is not included in the Planned Commercial Development. A note has been included on the associated development plan, stating: “Off-site detention will be provided on Lot 7 of 6WAK Addition. Detention basin will be privately-owned and maintained”. A Drainage Study has been approved by the City’s Stormwater Engineer.
Public Improvement Plans will need to be submitted to the Public Works and Utilities Departments for street/sidewalk, stormwater, sanitary sewer, and waterline improvements prior to recordation of the Final Plat at the Register of Deeds’ Office.
Easements
The subject platted property includes several utility and drainage easements that are being vacated as part of the subject replat application. New utility and drainage easements are being dedicated to accommodate the subdivision’s sanitary sewer, water, and stormwater infrastructure.
Conformance
The subject property is zoned PCD [6WAK] (formerly PCD-2) District. As the Preliminary Development Plan and rezoning applications were reviewed under the City’s previous zoning regulations, the Final Development Plan and Final Plat applications are also being reviewed under these regulations. The new lots meet the minimum lot area and dimensional requirements for Planned Commercial Districts.
Summary
In accordance with Section 21-302.2 of the Subdivision Regulations, the proposed lots will need to be pinned as a condition of plat approval. The Final Plat conforms with the previous Zoning and Subdivision Regulations.
