RE:

Health Department Regulations for Swimming Pools and Spas

The Lawrence-Douglas County Health Department has forwarded the attached request for City Commission approval of amendments to the Health Department’s regulations for swimming pools and spas. Per City Code Section 5-802 the Lawrence City Commission approves the regulations as adopted by the Health Department. The Health Department requests that the City Commission approve the amended regulations before the end of the year so that they may be effective January 1, 2008.

The attached executive summary details the changes that have made in the newly amended regulations.

City staff suggests some changes to the amended regulations. A reference in Section 5.B. to the “City of Lawrence Building Inspection Department” should read “Development Services Division, Planning and Development Department, City of Lawrence.” Also, Legal staff suggests adding provisions for an appeal process for pool and spa licenses that have been revoked by the Health Department.

11/13/07 UPDATE: Health Department staff acted upon the recommendations of City staff and made the changes highlighted in yellow in the attached draft regulations. The Board of Health will consider these changes on Monday, December 17. If approved by the Board of Health this will be the version considered by the City Commission on December 18.

ACTION:      Approve the Lawrence-Douglas County Health Department Regulations for Swimming Pools and Spas with 2007 Amendments, if appropriate.
