RE:

Vacation of Right-of-Way on 4th and Wisconsin

November 6, 2007 Agenda Item

Please include the following item on the City Commission Consent Agenda for consideration at the November 6, 2007 meeting:

On November 6, 2007 the City Commission will open/hold a public hearing on the application of Richard L. and Betty B. George for the vacation of the west 10’ of right-of-way of Wisconsin Street and the south 10’ of right-of-way of 4th Street, adjacent to the north half of the east half of Block 30, in the West Lawrence Subdivision.

The applicants desire to develop the property.  The vacation allows the setbacks to be reduced for the improvements.  Both 4th Street and Wisconsin Street have a large right-of-way dedication of 100’.  These are both considered local streets.

All utilities, as well as property owners within 200 feet, were notified and no objections were received.  Staff is recommending that easements be retained within the vacated right-of-way.

Action Requested:     Hold public hearing and, pending discussion, approve order of vacation retaining easements for utilities and public access.

Respectfully submitted,

Charles F. Soules, P.E.

Director of Public Works
