SPECIAL USE PERMIT NO. SUP-07-07-07

 

 

 

AN ORDINANCE PERTAING TO ZONING: AUTHORIZING A SPECIAL USE PERMIT FOR CERTAIN PROPERTY  LOCATED AT LOT 1 OF THE SE LAWRENCE BENEFIT DISTRICT NO. 1 ADDITION, LAWRENCE KANSAS.           

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

Section One: Special Use Permit Granted:  Pursuant to the regulations set forth in the Code of the City of Lawrence, Sections 20-1306 and 20-1307 permission is hereby granted to use in the manner set forth in Sections Two and Three, the following described property:

 

A TRACT OF LAND IN THE SOUTHWEST QUARTER OF SECTION 10, TOWNSHIP 13 SOUTH, RANGE 20 EAST OF THE 6TH P.M. IN DOUGLAS COUNTY, KANSAS DESCRIBED AS FOLLOWS:

 

COMMENCING AT THE SOUTHWEST CORNER OF SAID SOUTHWEST QUARTER; THENCE NORTH 01O30’50” WEST, ALONG THE WEST LINE OF SAID SOUTHWEST QUARTER, A DISTANCE OF 566.86 FEET TO THE POINT OF BEGINNING; THENCE NORTH 88O29’10” EAST, 81.27 FEET; THENCE ALONG A CURVE TO THE RIGHT, 62.08 FEET, SAID CURVE HAS A RADIUS OF 75.00 FEET AND A CHORD BEARING SOUTH 67O48’05” EAST, 60.32 FEET TO A POINT OF REVERSE CURVATURE; THENCE ALONG A CURVE TO THE LEFT 62.08 FEET, SAID CURVE HAS A RADIUS OF 75.00 FEET AND A CHORD BEARING SOUTH 67O48’05” EAST, 60.32 FEET; THENCE NORTH 88O29’10” EAST, 126.12 FEET; THENCE NORTH 01O30’50” WEST, 151.27 FEET; THENCE SOUTH 88O29’10” WEST, 317.85 FEET TO A POINT ON THE WEST LINE OF SAID SOUTHWEST QUARTER, THENCE SOUTH 01O30’50” EAST, ALONG THE WEST LINE OF SAID SOUTHWEST QUARTER, 102.75 FEET TO THE POINT OF BEGINNING, CONTAINING 41,458 SQUARE FEET OR 0.952 ACRES, MORE OR LESS.

 

Section Two: That the real property described in Section One shall hereafter allow a City pump station, a minor utility.

 

All Zoning ordinances or Zoning regulations of the City of Lawrence, Kansas affecting the use of the real property described in Section One which are inconsistent with this ordinance are hereby made inapplicable to the said property for said period of time. 

 

Section Three:  The Special Use Permit granted in Sections One and Two of this ordinance in addition to the full compliance with any general provisions contained in the Development Code of the City of Lawrence, is hereby made contingent upon the performance and observation of the following additional and supplementary regulations, stipulations, conditions, and restrictions, of which the violation of any hereafter enumerated will be a supplementary basis for the revocation of the special use permit in addition to those specified in Sections 20-1306, and 20-1307to wit:

 

1.       A variance must be obtained and noted on the site plan from the requirement in Section 20-913(e) which prevents the use of gravel as a parking area or driveway surfacing material or the plan must be revised to use a permitted surfacing material.

2.       Execution of a Site Plan Performance Agreement.

3.       Proposed screening from parkland requires approval of the City Landscape Supervisor.

4.   A revised Special Use Permit plan with the following changes:

1.         General Note 9 must be revised to reference 20-811(g)(8).

2.         The 40’ of right-of-way for E 1700 Road must be labeled as right-of-way, not as right-of-way easement.

3.         The plan must be corrected to read ‘Special Use Permit’ rather than ‘Use Permitted upon Review’.

 

Section Four: This ordinance shall take affect and be in force from _________, 2007and after its passage and publication as provided by law.
