Please include the following item on the City Commission consent agenda for consideration at the October 9, 2007 meeting:

Approval of a license agreement for parking stalls in public right-of-way – Michael Treanor, Trustee, for building at 9^th & Indiana.  This license agreement is for parking stalls in public right-of-way (R/W) of Indiana Street, north of 9^th Street.

Project History. The City has a 60-ft wide R/W for Indiana Street, north of 9^th Street. There are several existing parking stalls on the east side of the street adjacent to the building occupied by Owen’s Flower Shop. The stalls currently are signed as reserved spaces for Owen’s although there is no agreement with the City for private parking spaces within the R/W.

Proposed Project Details.  Michael Treanor, owner of the building housing Owen’s Flower Shop, is planning to make a number of improvements to the structure and the sidewalk in front of it. The work does not include the parking area. However, in reviewing the project area, staff suggested the license agreement in order to memorialize the current use in the R/W.

Proposed Project Status.  Plans for the building improvement projects have been submitted to the city although they do not specifically impact this license agreement.

Project Funding. No city funding for construction or future maintenance is involved.

Action Request. Public Works staff requests approval of the license agreement.
