Please include the following on the City Commission consent agenda for Oct. 2, 2007:

Mr. Jeffery Nus has requested to place a privacy fence in the right-of-way at the rear of his property at 1032 Rogers Place.  (email request attached)

Harvard Road has an 80 foot right-of-way.  The Nus’ original request located a water main within the confines of the fenced area (see attached map).  City staff has met with Mr. Nus and have agreed to an acceptable clearance in which to locate the fence.  The license agreement identifies this location to be 3’ north of the water main and 20’ from the back of curb.  The city Utilities Department has agreed to this location.  Other utilities (gas, electric, phone and cable) are also agreeable to this location.  The license agreement only allows the Nus’ to use part of the right-of-way for the express purpose of a fence and outlines the responsibilities of the license.  If the fence is ever damaged or needed to be removed it would be at the owners’ expense.
