RE:              Calculations for SUP-04-04-07 Protest Petition

The protest petitions filed in the City Clerk’s Office on June 6, 2007 pertaining to the referenced special use permit request contain enough signatures of the record owners of property within 1000’ of the property in the request to constitute a valid protest petition.  The sum total of the real property represented in the petition is 35.58% of the real property within the notification area, which is more than the minimum 20% required for a valid protest petition.

The protest petitions contain the names of property owners of 14 individual parcels of record.  One owner who signed the petition owns property outside the 1000’ buffer distance of the special use permit request so they were not included in the calculations to determine the validity of the petitions.

The attached map illustrates the properties within the 1000’ protest buffer area whose owners are protesting this special use permit request.

The calculations for determining the validity of the petition are shown below:

Total Area of all Parcels w/in 1000’ of the

Property in the Request                                  673.21 acres

Total Area of Parcels inside the 1000’ Buffer

Whose Owners are Protesting the

SUP Request (13 Parcels)                                239.53 acres

Percent of Total Parcel Area

in Protest Petition                                          239.53 acres/673.21 acres = 35.58%
