RE:	Local Burger Sidewalk Dining License

Local Burger Inc., d/b/a Local Burger, 714 Vermont Street, recently applied for a sidewalk dining license.  The related site plan (SP-07-59-05) was approved by the City Commission September 11, 2007 as part of this process.  The applicant has met all necessary requirements to obtain a sidewalk dining license, including demonstrating that it meets the seventy percent (70%) food sales requirement.  In addition, the applicant requested that its patrons be allowed to possess and consume alcoholic beverages in the outdoor seating area.  As such, enclosed is Ordinance No. 8157, after its effective date, would allow possession and consumption of alcoholic beverages on this portion of city right of way. 

Staff recommends approval of the sidewalk dining license for Local Burger Inc. d/b/a

Local Burger and place on first reading Ordinance 8157 for approval.
