2104 and 2106 Greenbrier (MS-05-07-07) Ordinance Variance Request |
Please include the following item on the City Commission consent agenda for consideration at the August 7, 2007 meeting:
Approval of the request by Bo Newsom, property owner of 2106 Greenbrier Drive, and Brad Parsons, property owner of 2104 Greenbrier Drive, for a variance from 19-214B of the code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet. The service line for both lots has been located within the right of way for greater than 15 feet, but is not located under pavement. The lots were platted in 1980 and the public improvements were constructed in 1980. City Code 19-214 was adopted in 2004.
Approval of the request by Bo Newsom, property owner of 2106 Greenbrier Drive, and Brad Parsons of 2104 Greenbrier Drive, for a variance from 19-214(C) that states ‘A private sanitary sewer service line shall only serve one residential dwelling unit.’ The private sanitary sewer lines for both properties combine to one service line before connecting to the public sanitary sewer main. Both property owners have signed an agreement concerning the maintenance of these lines. The agreement will be recorded at the Register of Deeds once the variance has been granted by the City Commission. A copy of the agreement with book and page will be provided by Bo Newsom to the Department of Utilities.
Action Request. Utility Department staff requests approval from the City Commission to grant the requested variances from 19-214 of the code for Lots 1 and 2 of Golf Club No. 2 Subdivision Plat (2104 and 2106 Greenbrier Drive).
