Oread L.C. is the property owner and applicant for the vacation of a 50 ft. right-of-way at 1100 E. 23rd Street. In 1977 the lot was platted with an additional 50 ft. of right-of-way. The property is developing with a dental facility, and cross access is being requested by the city. The owner/applicant is requesting, and staff recommends, that this additional right-of-way be vacated to allow for parking and cross access with the property to the east. This vacation and usage would be consistent with similar actions approved for the Quiktrip project at Haskell Avenue. A 60 ft. right-of-way will still exist north of the center line on 23rd Street.
All utilities, Planning, and neighboring properties were notified of this request and no objections were received.
Action Requested: Open public hearing and, pending comment and discussion, approve vacation if appropriate, conditioned upon approval of the public access agreement on the site plan.
