ITEM NO. 1:         Action summary

Motioned by Commissioner Sizemore, seconded by Commissioner Antle to approve the March 15, 2007 Action Summary.

 

Motion carried unanimously, 4-0-1, with Commissioner Marvin abstaining.

 

ITEM NO. 2:         CoMMUNICATIONS

a)     Receive communications from other commissions, State Historic Preservation Officer, and the general public.

 

-934 W. 21st Street, Double Hyperbolic Paraboloid House to be considered for State and National Registers.

 

-1646 Massachusetts Street, the Edward House House has been officially listed in the National Register of Historic Places.

ITEM NO. 3:        DR-02-11-07     123 W. 8th Street (Standard Mutual Life Building/Fraternal Aid Building); Exterior Modifications; Certified Local Government Review.  The property is listed as a key contributing structure to Lawrence’s Downtown Historic District, National Register of Historic Places and is located in the Downtown Conservation Overlay District.  Submitted by Thomas Fritzel of Gene Fritzel Construction Inc. for One Two Three LLC, the property owner of record.

 

STAFF PRESENTATION

Staff presented photographs of all elevations of the structure.

  

Applicant presentation

Mr. Tim Homberg spoke on behalf of Mr. Thomas Fritzel of Gene Fritzel Construction Inc., and stated all concerns from the previous meeting had been addressed.  The Staff report recommended the removal of the west and south dormer.  Computer drawings of two sides of the building illustrate the notched-in dormers have little effect on the roof.  The applicant requested the Commission consider keeping these two dormers.  The applicant agreed to do a window survey and repair the windows that need to be repaired.

 

                        Commissioner Marvin asked if the doorway on the south elevation would be through a window opening.

 

Mr. Homberg stated only on one floor would a new opening be created.

 

                        Commissioner Meyer asked Mr. Homberg if the project was approved with the dormer condition as it was, would it have an effect on the final plan.

                       

                        Mr. Homberg answered no, but would like to have the amenities to capture a view of the campus.

 

Commissioner Sizemore asked about the size of the windows.

 

Mr. Homberg answered 6.5’ x 30”.

 

          Commissioner Veatch stated at the last HRC meeting it was noted the windows were for ventilation.

                       

                        Mr. Homberg stated the space would be reutilized in the attic and the mechanical would be in the heart of the building, the dormers were strictly for light.

 

                        Commissioner Sizemore asked Mr. Homberg what the height of the elevator would be and if there were plans for it.

 

Mr. Homberg answered the elevator would be covered by the roof lines and it was basically at the loft level.

 

                        Commissioner Sizemore asked what would be done with the existing roof above the penthouse and stairs.

                       

                        Mr. Homberg answered the existing building has flush eves on the south side and the structures would go straight up from the existing roof.

 

Commissioner Sizemore asked if there were existing gutters.

 

Mr. Homberg answered there was a prefabricated gutter.

 

Commissioner Sizemore asked how much existing material would be removed to divert water.

 

Mr. Homberg stated some roof tiles would be removed to create a sheet metal type cricket to divert water.

 

Public Comment

Mr. Dennis Brown, president of The Lawrence Preservation Alliance requested the project be rejected. He stated it was not subordinate, it was listed as a key contributor and if changes were made to the proposal, it would minimally meet the standards.  He asked why the insistence of the extra tenant parking component.  Mr. Brown requested flattening the plane on the south wall.  He stated the rubble stone was too busy and had no correlation to the Historic District, the LPA opposed the project and it should be rejected. 

 

Mr. Tom Wilcox, Round Corner Pharmacy owner stated he was concerned with the parking situation in the back of the building.  He said it was the life line of downtown Lawrence and was critical because most of his business now is delivery.  He stated he was against taking a parking lot for development.

 

COMMISSION DISCUSSION

                        Commissioner Antle stated the parking lot issue would be decided by the City Commission.

 

                        Commissioner Meyer said she had office space on the third floor of the building years ago and improvements needed to be done.  She said there were a lot of stairs and her clients had a difficult time getting to her office.  She stated she was not opposed to the addition; perhaps some extra office space might be necessary because the offices were small.  She did not think the dormers were necessary, and that the south elevation is not the key component to the building.

 

                        Mr. Homberg stated even if the minimum width of stairs was built, they would still encroach over the line; there is not enough room on the east side of the building.

 

                        Commissioner Sizemore stated the applicant had progressed from the original design, keeping in scale with the existing building, but the addition was too much with gables and the rubble stone.  He agreed the building could have an addition and meet all standards by simplifying the shape and form of the building.

 

                        Commissioner Veatch asked Commissioner Sizemore if it was the height that disturbed him the most.

                       

                        Commissioner Sizemore answered that he did not think the back of the building tied together with the rest of the building. 

 

                        Commissioner Marvin asked if the parking spaces were safe regarding pulling out of one.

 

Mr. Homberg stated it was a one way lot and the spaces were normal size.

 

                        Commissioner Antle stated he believed the building could be simplified and asked if the project would be economically viable without the additions.

 

Mr. Homberg answered he thought the plan was better than just an addition, that a smaller addition would not look better.

 

                        Commissioner Meyer asked where the elevator would be placed.

 

Mr. Homberg stated the number one challenge was to get the elevator to reach all three floors, to get the stairs and elevator in and not affect the roof line.

 

Commissioner Antle said he was in favor of the project with Staffs recommendation.

                       

                        Commissioner Veatch asked Mr. Homberg to address the flattening of the southern elevation.

                       

                        Mr. Homberg stated he was playing off the existing structure but was not opposed to one plane.

 

Commissioner Antle asked if these adjustments could be approved by the ARC.

 

Ms. Braddock Zollner answered yes.

 

Commissioner Antle stated guidance would be given.

 

Ms. Braddock Zollner stated the Commission could appoint an additional member to the ARC.

                       

                        Commissioner Veatch stated the building needed renovated and updated, and a smaller addition may not be viable.

 

                        Commissioner Marvin stated she was not convinced this was a good plan.

 

Mr. Homberg said he wanted to get the project to the City Commission.

 

The Commission discussed the flattening of the south elevation to be part of the final design to be approved by ARC.

 

ACTION TAKEN

Motioned by Antle, second by Veatch, to approve the Certified Local Government Review for the an addition to the structure located at 123 W. 8th Street as presented, based on a determination that it will not encroach upon, damage or destroy any listed property or its environs with the following conditions:

 

  1. The applicant remove the west dormer on the south elevation and the north dormer on the east elevation;

 

  1. The windows will be repaired and replaced only when the severity of the deterioration warrants.  A window survey shall be approved by the HRA before the removal of any windows occurs;

 

  1. Windows affected by the new addition will be sealed in place with window surrounds exposed, if possible, or stored on site if required to be removed;

 

  1. The applicant provide complete construction documents with material notations, including skylight and dormer specifications, to be reviewed and approved by the Architectural Review Committee prior to release of a building permit;

 

  1. Any changes to the approved project will be submitted to the Historic Resources Commission prior to the commencement of any related work.

 

Motion carried 3-2 with Commissioners Marvin and Sizemore in opposition.


 

 

 

ITEM NO. 4:        DR-03-20-07    1307 and 1313 Massachusetts Street; Special Use Permit/Adaptive Reuse; Certified Local Government Review and Certificate of Appropriateness Review.  The property, the John N. Roberts House, is listed individually on the National Register of Historic Places and the Lawrence Register of Historic Places.  Submitted by CP & Associates for the Libuse-Kriz-Fiorito Historical Foundation, the property owner of record.

 

STAFF PRESENTATION

Staff presented photographs of the John N. Robert’s House (1307 Massachusetts) and its ancillary structure, and the structure located at 1313 Massachusetts Street.

 

Applicant presentation

Mr. Michael Cornwell, the project architect, stated they would like to enclose the south porch so that the caterers could perform food preparation for which more floor space was needed.  An elevator would be installed to comply with ADA standards.

 

Commissioner Marvin asked how the catering carts would be brought in.

 

Mr. Cornwell stated the logic behind enclosing the porch is for useable space for caterers, by filling the opening between the columns with a single hung window that resembles the flower room, and doors at the top of a new set of stairs to the porch.  The staff report recommended keeping the porch open, but he would like to see it enclosed.

 

Commissioner Veatch asked if the enclosure of the porch could be made to look simpler.

 

Mr. Cornwell stated yes it could be made simpler.

 

Public Comment

Mr. Dennis Brown, president of The Lawrence Preservation Alliance stated he supported the project because it would be for special events and not a restaurant.  Mr. Brown said he believed the public was in support of the project.

 

Ms. K.T. Walsh, 732 Rhode Island, stated she was in complete support of the project but is uncomfortable with an outside wheelchair lift because they rust and have to be replaced.

 

COMMISSION DISCUSSION

Commissioner Meyer asked Staff what was recommended regarding the porch.

 

Ms. Braddock Zollner said staff recommended that if the porch is enclosed that it be done in a simple manner that can be easily reversed in the future.

 

Commissioner Sizemore asked Mr. Cornwell if a ramp could be installed instead of a lift.

 

Mr. Cornwell stated the first floor is too far away for a ramp to be installed and that the least obtrusive lift would be purchased and installed.  He said the old stone from the porch would be marked and saved for future use.

 

Commissioner Antle stated he was in support of the project and the existing lighting on the outside should be allowed to remain.

 

Commissioner Meyer suggested no additional lighting be installed.

 

Commissioner Veatch suggested the design of the porch should be improved.

 

ACTION TAKEN

Motioned by Veatch, second by Marvin, to approve the Certified Local Government Review and Certificate of Appropriateness for the special use permit/adaptive reuse of the structures located at 1307 and 1313  Massachusetts Street as presented, based on a determination that it will not encroach upon, damage or destroy any listed property or its environs with the following conditions:

 

1.      The applicant retain and store the existing screen door to be removed from the north porch on site;

 

2.      The applicant retain and store on site the stone guardrail removed from the north porch;

 

3.      The design of the south porch shall be simplified and the stair shall be reduced in size, with final design to be reviewed and approved by the Historic Resources Administrator (HRA) prior to release of a building permit;

 

4.      Mechanical equipment located at the northwest corner of the structure shall be screened with HRA approved material or landscaping;

 

5.      One sign, to be approved by the HRA and permitted by Neighborhood Resources, shall be permitted;

 

6.      The applicant provide complete construction documents for the design and installation of the fountain to be approved by the HRA prior to the release of a building permit;

 

7.      No additional up lighting of the building shall be installed;

 

8.      The applicant provide complete construction documents, including interior finishes, with material notations, including window, door, wheelchair lift, permeable pavement, ground lighting, trash enclosure, and fence details, to be reviewed and approved by the Historic Resources Administrator prior to release of a building permit;

 

9.      The applicant provide railing details to be reviewed and approved by the Historic Resources Administrator prior to release of a building permit;

 

10.  Any alterations to the structure at 1313 Massachusetts Street must be submitted to the HRA prior to the commencement of any related work;

 

11.  This recommendation is given with the understanding that the City Commission must approve the associated Special Use Permit.  Approval of this request by staff or the HRC does not guarantee the City Commission will approve the associated Special Use Permit; 

 

12.  The applicant shall comply with all of the terms and conditions of the Special Use Permit as approved by the City Commission.

 

          Motion carried unanimously, 5-0.

 

Ms. Braddock Zollner noted for the record that the applicant has worked diligently with many different groups in the community to create a special event venue that will enhance the City of Lawrence while protecting this valuable historic resource.

 

ITEM NO. 5:        DR-03-21-07    820 New York Street; Porch Enclosure Addition; Certified Local Government Review.  The property is located in the environs of St. Luke African Methodist Episcopal Church (900 New York), Register of Historic Kansas Places.  Submitted by Sarah Rooney and Benjamin MacConnell, the property owners of record.

 

STAFF PRESENTATION

Staff presented photographs of the structure; properties located in the 800 Block of New York Street, and St. Luke African Methodist Episcopal Church, Register of Historic Kansas Places.

 

Applicant presentation

Ms. Sarah Rooney, the applicant, stated she made a decision of a simple addition to create a living space for a child because she was pregnant, and the second bedroom had no closet.  She said she was trying to work within a budget of $10,000.00, the back addition was unstable, the structure was questionable and hardly standing when she had purchased the home.  She said she had all the beams sistered, and had a steel beam placed under the center of the home.

 

Ms. Rooney stated she loved the house, and loved east Lawrence.

 

COMMISSION DISCUSSION

Commissioner Antle stated if the project was approved the applicant should use wood or aluminum clad windows.

 

Ms. Rooney said some of the windows in the rest of the house were vinyl.

 

Commissioner Veatch stated that was something that was normally required and asked if that would put the applicant over budget.

 

Ms. Rooney stated she had not looked at the price of wood windows.

 

Commissioner Veatch clarified they could be aluminum clad.

 

Commissioner Sizemore stated an option might be to remove the window from the front of the house and salvage it.

 

Ms. Rooney stated the window itself was broken and she did not think it would be able to survive being moved.

 

Mr. Rooney (father of Sarah) stated the center of the house had been raised 6 ½”, the original house had only been 20x30 feet and that two additions had been added.

 

Commissioner Meyer asked Mr. Rooney if he had read Staff recommendations and if he had considered meeting with Staff to review other options.

 

Mr. Rooney stated he was an architect in Kansas, Missouri, and Nebraska, and had been a Planner for Black and Veatch and he believed they had considered all options.

 

Commissioner Veatch stated this type of addition did not meet standards and was economically driven.

 

Commissioner Antle stated he agreed but was inclined to make some allowances because of the exiting structure.

 

Public Comment

Ms. K.T. Walsh, 732 Rhode Island, stated she was a friend of the applicant and suggested she call Mike Goans in regards to replacing the windows.  She said she thought the line of sight might be an issue.

 

Commissioner Veatch asked Ms. Walsh if she was in favor of the project.

 

Ms. Walsh stated the association had not yet voted on the project.

 

Commissioner Meyer said she thought a big Bay window would stick out and that some work needed to be done on the project.

 

Ms. Rooney said if there was a way to use the old window, she would prefer to.

 

Commissioner Sizemore stated there were two elements that stand out.  The bay window and the lattice are not in character.  He said that if an addition was going to be built, make it look like an addition.

 

Mr. Rooney said the existing tree and its roots made it difficult to enclose the foundation of the addition. 

 

Commissioner Sizemore stated other than those two things, he agreed this type of addition was a typical one for the neighborhood, but would not agree with the bay window.

 

ACTION TAKEN

Motioned by Commissioner Sizemore, second by Commissioner Antle, to approve the Certified Local Government Review and determine that the front porch addition at 820 New York Street would not encroach upon, damage or destroy the listed historic property or its environs with the following conditions:

 

1.      If possible, the applicant salvage the front window and use it on the front window of the addition, with approval of the front window of the addition to be reviewed and approved by the Historic Resources Administrator (HRA) prior to release of a building permit;

 

2.      The applicant use wood windows or aluminum clad wood windows;

 

3.      The applicant provide complete construction documents, with material notations and window specifications to be reviewed and approved by the HRA prior to release of a building permit;

 

4.      Any changes to the approved project will be submitted to the Historic Resources Commission prior to the commencement of any related work.

 

 

Motion passed 3-2, with Commissioners Veatch and Meyer in opposition.


 

ITEM NO. 6:        DR-03-23-07    529 Tennessee Street; New Construction of Ancillary Structure and Exterior Modifications; Certified Local Government Review.  The property is listed as a contributing structure to the Pinckney I Historic District, National Register of Historic Places.  Submitted by Gary O’Doniel for Donald Marquis, the property owner of record.

 

STAFF PRESENTATION

Staff presented photographs of the main structure, the alley and ancillary structures in the 500 Block of Tennessee Street. 

 

Applicant presentation

The applicant, Mr. Gary O’Doniel, was present. 

 

Mr. Donald Marquis, property owner, stated there were two components to his request, the kitchen and garage.  A window in the kitchen of the 1920’s bungalow was an issue.  An addition was built to extend the kitchen in the early 80’s. On the north side of the kitchen is a closet with bi-fold doors which need to be removed to enlarge the kitchen.  Mr. Marquis said he would like to have three windows on the south side of the kitchen and would make them look as much as possible like the existing windows.

 

The applicant, Mr. Gary O’Doniel stated the lap siding would be removed and the entire exterior would be covered with stucco.

 

Mr. Marquis stated he would like to have a nice garage for his car and would like to open it up to the alley.  He stated his house was the only house on the west side that is one story. 

 

COMMISSION DISCUSSION

Commissioner Antle asked Mr. Marquis if he had seen the Staff recommendations.

 

Mr. Marquis stated the windows he would install would look historic and asked if a breezeway would work.

 

Commissioner Veatch stated a breezeway would work, because the garages in the area were detached and a breezeway might look detached.

 

Mr. O’Doniel said entering the garage from the alley is using the space the best way.  The original kitchen was 8’ across and that window was now outdated. 

 

Commissioner Antle said Staff was not concerned with the other windows, only the historic windows.

 

Mr. O’Doniel agreed the historic window was the issue and asked how to manage the appearance on the outside, but continue with the remodel on the inside. 

 

Mr. Marquis stated he would duplicate the windows with mid 20’s style.

 

Commissioner Meyer asked if all three windows would look like the window that was there now.

 

Mr. O’Doniel answered yes.

 

Commissioner Marvin asked if the window could be moved to the newer part of house in the back.

 

Mr. O’Doniel said the bay window was where the kitchen started and they would like to center the three windows in the cabinet bank which would cause them to lose the little window.

 

Commissioner Marvin said that was understood but they were crossing the boundary saying it could look historic.

 

Mr. O’Doniel stated he would be sensitive to the window but the problem would be the 80’s addition and the decision was made in design of that.  He said he would compromise the use of the kitchen on the inside or the look on the outside.

 

Mr. Marquis asked if two windows that looked exactly like the little window were put in would it be acceptable.

 

Commissioner Sizemore stated that if the entire house was stucco, the garage was added and the windows were installed, the house would not appear to be historic.

 

Commissioner Antle suggested Staff and the applicant work through the problems instead of making a decision now.

 

Commissioner Marvin asked if there was any consideration placing the garage closer to the south lot line.

 

Mr. Marquis said yes.

 

Commissioner Marvin asked Staff if that would be a problem.

 

Ms. Braddock Zollner said it depended on how it was attached to the main house, if the garage was attached it would not meet the rear yard setback.

 

ACTION TAKEN

Motioned by Commissioner Antle, second by Commissioner Veatch, to approve the Certified Local Government Review for the new construction of an ancillary structure and exterior modifications of the main structure located at 529 Tennessee Street as presented, based on a determination that it will not encroach upon, damage or destroy any listed property or its environs with the following conditions:

 

1.      The applicant work with the Architectural Review Committee (ARC) to alter the design of the garage to be detached or attached with a hyphen;

 

2.      The historic window will not be removed;

 

3.      The applicant may install a new window to be approved by the ARC on the non-historic addition;

 

4.      The applicant provide complete construction documents with material notations and specifications to be reviewed and approved by the Historic Resources Administrator prior to release of a building permit;

 

5.      Any changes to the approved project will be submitted to the Historic Resources Commission prior to the commencement of any related work.

 

          Motion carried unanimously, 5-0.


 

ITEM NO. 7:        DR-03-25-07    644 New Hampshire Street; Addition; Certified Local Government Review.  The property is located in the environs of the U.S. Post Office (645 New Hampshire), Lawrence’s Downtown Historic District, the North Rhode Island Historic District, and the Eldridge Hotel (701 Massachusetts), National Register of Historic Places.  The property is also located in the Downtown Conservation Overlay District.  Submitted by Treanor Architects for the World Company, the property owner of record.

 

STAFF PRESENTATION

Staff presented photographs of structure, the current satellites and the line of sight to the listed property. 

 

Applicant presentation

The applicant, Chris Cunningham, Treanor Architects, was present and stated architecturally he tried to pull features from the U.S. Post Office at 645 New Hampshire and upgrade the concrete.

 

Commissioner Sizemore asked if there were plans to conceal the existing structure.

 

Mr. Cunningham said those plans were still being processed.

 

Ms. Braddock Zollner stated the applicant had worked with staff on the design so that in the future it could be converted into a compatible three-part commercial storefront. 

 

Public Comment

Ms. K.T. Walsh stated when the neighborhood met with the applicant previously, the applicant stated the building would be torn down.  Ms. Walsh requested the applicant to pay more attention to the single family housing on the other side.

 

Mr. Cunningham stated the four-story building is so far off that there are no plans of doing drawings.

 

Ms. Walsh asked that the applicant install quiet heating and air like the ones installed at Hobbs Taylor Lofts.

 

Mr. Cunningham stated he would check on the noise level.

 

 

COMMISSION DISCUSSION

ACTION TAKEN

Motioned by Veatch, second by Antle, to approve the Certified Local Government Review for the addition to the main structure located at 644 New Hampshire Street as presented, based on a determination that it would not encroach upon, damage or destroy any listed property or its environs with the following conditions:

 

1.      The applicant provide complete construction documents, with material notations to be reviewed and approved by the Historic Resources Administrator prior to the release of a building permit.

 

2.      The applicant sufficiently complete the site plan process pursuant to Section 20-1305 of the Code of the City of Lawrence, if required by the Director of Planning, as well as obtain any necessary variances from the Board of Zoning Appeals; Approval of this application by the HRC does not guarantee the approval of the associated site plan or any required variances;

 

3.      Any changes to the approved project will be submitted to the Historic Resources Commission prior to the commencement of any related work.

 

          Motion carried unanimously, 5-0.


 

 

ITEM NO. 8:        DR-03-22-07    315 E. 7th Street; Replacement of Exterior Stairs; Certified Local Government Review.  The property is located in the environs of the North Rhode Island Historic District, National Register of Historic Places.  Submitted by Jonah Seibel for Lance Burr, the property owner of record.  

 

STAFF PRESENTATION

Staff presented photographs of structure, the existing stairs, and other stairs on the structure. 

 

Applicant presentation

The applicant, Jonah Seibel, was present. 

 

Mr. Seibel stated most of the work had been completed. The wood staircase was starting to rot, and there needed to be a more durable material that would last forever, rather than replacing the stairs in twenty years.

 

Commissioner Antle asked if the project had been completed.

 

Mr. Seibel said it had been completed off site but had not been installed.

 

Public Comment

COMMISSION DISCUSSION

Commissioner Antle asked how long the previous system had been in place on the house.

 

Mr. Seibel stated approximately 20 years.

 

Commissioner Meyer asked if the stairs would be the same as they are now or would they be metal.

 

Mr. Seibel said they were basically the same.

 

Commissioner Sizemore asked if the balcony had been constructed.

 

Mr. Seibel said the balcony would not be replaced.

 

Commissioner Marvin asked if this was a problem with code issues.

 

Commissioner Sizemore said the existing is not up to code, the slats were not close enough together.  He said maybe the steel is more appropriate to make the stairs disappear. The visual lines would be smaller because it is metal.

 

Commissioner Meyer said the metal had a commercial appearance, this was next to the district and she was not in favor.

 

Mr. Seibel stated the reason these were not seen on more residential is that they were expensive.

 

Commissioner Sizemore said wood or metal would not have an impact on the environs.

 

 

ACTION TAKEN

Motioned by Meyer, second by Veatch, to deny the Certified Local Government Review for exterior stair replacement on the structure located at 315 E. 7th Street as presented, based on a determination that it would encroach upon, damage or destroy the listed property or its environs. Specifically, the project does not meet Standard # 7, “The new work shall be compatible with the historic materials, character-defining features, size, scale and proportion, and massing of the environs.”

 

 

Motion passed 3-2, with Commissioners Sizemore and Antle in opposition.

Landmark Nomination Committee Update and Request.

 

Staff presented an update on the Committee work.

 

Commissioner Veatch stated he was not comfortable with the low numbers.  There are 500 property owners that could way in but only 21 had responded.

 

Commissioner Veatch suggested a mailing and said Ms. Laura Wagner had volunteered to rewrite the letter.

 

Ms. Braddock Zollner suggested an online survey in addition to the letter.

 

Motion by Commissioner Sizemore, seconded by Commissioner Veatch to direct staff to place on the May agenda a resolution requesting the Lawrence City Commission adopt an ordinance that will amend Chapter 22 of the Code of the City of Lawrence to allow for properties currently listed on the National Register of Historic Places and/or the Register of Historic Kansas Places to be listed on the Lawrence Register of Historic Places. 

Motion passed unanimously, 5-0.

 

Ms. Braddock Zollner gave an update on 1211 Rhode Island Street, the demolition of property and building a duplex.  The owner’s agent intends to submit for the May meeting.

 

Ms. Braddock Zollner said May is historic preservation month and Staff had considered a public education session, to be held at City Hall.  The State Historic Preservation Conference will be in Dodge City.  If any Commissioners would like to participate, please contact staff by April 27th
