Ord. 8103 - 2300 Louisiana Utility Easement Acquisition/Condemnation

 

 

Background Information:

On February 20, 2007, the City Commission received a request from the owners of property located north and east of the Checkers grocery store property, 2300 Louisiana, to initiate condemnation proceedings for the acquisition of a permanent utility easement and a temporary construction easement (staff memo).  The Commission authorized the use of the City’s eminent domain authority to acquire the needed easements for the project.  The developers have agreed to pay all costs associated with the condemnation process and the easement acquisition.

 

On April 3rd, the City Commission authorized the filing of a survey and declared the necessity of condemnation by adopting Resolution 6711.

 

The City Attorney has prepared the attached ordinance, ordering the condemnation of the required property interests and authorizing the filing of a petition in district court. 

 

Staff Recommendation:

Adopt Ordinance 8103 on first reading.
