RE:	Lawrence Freenet’s Request to Install Equipment on the City’s Harper Water Tower

Lawrence Freenet proposes to install equipment on the City’s water tower on Harper Street to operate an internet access point.  The Planning Department has administratively approved the proposed installation.

Sprint owns the antenna pod on the top of the tower and is agreeable to allowing Freenet to install equipment on the pod at no charge to Freenet.  Sprint and Lawrence Freenet will enter into a lease agreement.  City staff has prepared an amendment to the City’s site agreement with Sprint authorizing Sprint to sublease space on the pod to Lawrence Freenet.  The amendment is under review with Sprint’s legal department.    

Staff recommends the City Commission authorize the City Manager to enter into an agreement

with Lawrence Freenet for the Harper water tower site in substantially the form of the attached agreement.  Upon receiving a copy of the fully executed Sprint – Lawrence Freenet agreement, the City Manager can then execute the City’s agreement with Lawrence Freenet.
