Please include the following item on the consent agenda for the April 17, 2007 City Commission meeting.
Enter into a License Agreement with Matthew F. Gillhousen to allow for the continued use of an existing asphalt driveway that traverses the unimproved right-of-way of North 6th Street extended south of Walnut Street.
Project Description: This request is associated with the 6th and Walnut Addition final plat which was approved by the City Commission on February 20, 2007. The subject property is located at the southeast corner of 6th and Walnut Streets in North Lawrence and is home to an existing residence. This residence takes access to Walnut Street via the right-of-way for 6th Street. Use of the right-of-way must be permitted through a license agreement, signed by the City Manager. The City Commission must authorize the City Manager to enter into this agreement.
Project History: The City Commission approved this final plat on February 20, 2007. On February 27, 2007, the City Commission approved a variance from Section 19-214B of the City Code which prohibits certain locations for private sanitary sewer lines. The existing residence has taken access to Walnut Street in this manner for some time. The Public Works Department has no short term plans to improve 6th Street south of Walnut Street and therefore does not object to this request.
Project Funding: No new improvements are proposed, and any future maintenance costs for the existing improvements will be the responsibility of the Licensee.
Action Request: Authorize the City Manager to enter into a License Agreement with Matthew F. Gillhousen to allow for the continued use of an existing asphalt driveway that traverses the unimproved right-of-way of North 6th Street extended south of Walnut Street.
