Res. 6711 - 2300 Louisiana Utility Easement Acquisition/Condemnation

Background Information:
On February 20, 2007, the City Commission received a request from the owners of property located north and east of the Checkers grocery store property, 2300 Louisiana, to initiate condemnation proceedings for the acquisition of a permanent utility easement and a temporary construction easement (staff memo). The Commission authorized the use of the City’s eminent domain authority to acquire the needed easements for the project. The developers have agreed to pay all costs associated with the condemnation process and the easement acquisition.
The City Attorney has prepared the attached resolution which declares the necessity of condemning the property interests and the filing of a survey describing the interests to be condemned. After adoption of the resolution, a condemnation ordinance will be prepared for commission consideration.
Staff Recommendation:
Adopt Resolution 6711.
