Baldwin Creek: Pump Station 48 project – utility easements

Please include the attached Ordinance 8085 on the April 3, 2007 City Commission agenda. The ordinance authorizes initiation of eminent domain proceedings to acquire needed utility easements for the Pump Station 48 site (map). Electrical easements are required on four tracts (map) in order to serve the pump station site with dual sources of power. While offers of compensation have been made to these owners by the property acquisition team, in order to meet project deadlines, condemnation proceedings may be necessary in the event that negotiated settlement cannot be reached. Construction is currently underway on the pump station site and the project is scheduled for completion by this summer.
Previously the commission authorized the use of eminent domain authority with the adoption of Resolution 6677.
