ANNUAL RACIAL PROFILING COMPLAINT REPORT

(Pursuant to L. 2005, Ch. 159 ‘5)

(Sub. Senate Bill 77)

 

“Each law enforcement agency shall compile an annual report of all complaints of racial profiling received and shall submit the report on or before January 31 to the office of the attorney general for review. The annual report shall include: (1) The date the complaint is filed; (2) action taken in response to the complaint; (3) the decision upon disposition of the complaint; and (4) the date the complaint is closed. Annual reports filed pursuant to this subsection shall be open public records and shall be posted on the official website of the attorney general.”

            Action taken in response to complaint:

 

            Received a telephone message from the mother of an individual who was given a ticket for loud car stereo. She claimed it was racial profiling. Attempted to return her call several times and left messages. Sent a letter to the address on the ticket. Never received a return call and letter was returned. Interviewed the officer who wrote the ticket and the second officer who was present. Reviewed the tickets issued by the officer and all other officer that night.

 

            Decision upon disposition of complaint:

 

            Complaint unfounded. Initial complaint made by a 3rd party who was not present at time of incident. Officer could not see who was driving vehicle prior to stop because it was dark outside and the vehicle had tinted windows. Stopped vehicle based on loud stereo only.
