ITEM NO. 2: FINAL PLAT FOR EAST HILLS BUSINESS PARK NO. FOUR; 3841 GREENWAY CIR (LAP)
PF-12-33-06: Final Plat request for East Hills Business Park No. Four, located at 3841 Greenway Circle. The one-lot industrial site contains approximately 12.907 acres. Submitted by Landplan Engineering for API Universal Foils Inc., property owner of record.
STAFF RECOMMENDATION: Staff recommends approval of the Final Plat for East Hills Business Park No. Four and forwarding it to the City Commission for acceptance of easements, subject to the following conditions: 1. Provision of the following fees and recording documentation: a) A current copy of a paid property tax receipt. b) An approved Master Street Tree Plan in accordance with Section 21-708a.3. c) An Agreement Not to Protest a Benefit District for Street and Sidewalk Improvements to Noria Road. d) Recording fees made payable to the Douglas County Register of Deeds. 2. Submittal of a Temporary Utility Agreement. 3. Submittal of Public Improvement Plans for the construction of sidewalks, if the sidewalk is placed within the right-of-way. If the sidewalks cannot be placed within the right-of-way, pedestrian easements will need to be shown on the plat. 4. Revision of the plat to include the following: a) A 10-foot wide utility easement along the north side of the lot. b) A minimum elevation for building opening (MEBO) for the lot. |

STAFF REVIEW
The applicant proposes to combine Lot 1, Block Two, East Hills Business Park and an adjacent unplatted parcel. The replat is needed to formally combine property for the expansion of the existing API Universal Foils, Inc. building, which is located on the existing platted lot. The unplatted parcel was included as part of the preliminary plat for East Hills Business Park, which was approved in 1987. The site is located west of Noria Road and north of K-10.
Sidewalks
Six-foot wide sidewalks were installed along the north side of the existing platted lot in 1994. A sidewalk also exists along the north side of the unplatted parcel, but it is unknown at this time if this sidewalk is built to current City standards. This sidewalk portion will be further evaluated with the forthcoming site plan. Staff recommends that a new five-foot wide sidewalk be constructed abutting the proposed lot along the east side of Greenway Drive. If the sidewalk is not able to be placed within the Greenway Drive right-of-way, a pedestrian easement will need to be added to the plat. Public Improvement Plans will need to be submitted for the sidewalk if it is placed within the right-of-way.
A sidewalk does not abut the property along Noria Road, as a portion of this roadway is not located within the City limits, and the portion located within the City is not constructed to City standards. An Agreement Not to Protest a Benefit District for Street and Sidewalk Improvements to Noria Road is a condition of plat approval.
Street Rights-of-Way
No new rights-of-way are being dedicated with this plat, as the current rights-of-way are sufficient. Noria Road, a minor arterial, includes 90 feet of right-of-way; Greenway Circle, a collector, includes 100 feet of right-of-way, and Greenway Drive, a local street, includes 80 feet of right-of-way. A 100-foot wide strip of land is located directly west of the Noria Road right-of-way to accommodate a possible future Eastern Parkway. This land is owned by Douglas County.
Infrastructure
Existing water mains are located within the rights-of-way of Greenway Circle, Greenway Drive, and Noria Road. The existing platted lot, Lot 1, Block Two, East Hills Business Park, also includes a private waterline. Sanitary sewer service abuts the property along its northern, western, and southern property lines. Additional utility easements are being dedicated along these property lines to ensure proper coverage of the existing sewer system. A Downstream Sanitary Sewer Analysis has been approved by the City’s Utilities Department. Storm channels are located to the north and east of the property. Stormwater mains are located along northern, western, and eastern edges of the proposed lot.
Floodplain Overlay District
A portion of the property is located within the City’s Floodplain Overlay District (Zone AE). As such, a Floodplain Development Permit will need to accompany the forthcoming site plan. As a condition of plat approval, a minimum elevation for building opening (MEBO) will need to be provided for the proposed lot, since a portion proposed lot is encumbered by the Floodplain Overlay District.
Conformance
The replat meets the minimum lot size (5,000 square feet) and width (50 feet) for lots in the IG (General Industrial) District. Setbacks, maximum lot coverage, and maximum impervious lot coverage will be evaluated with the forthcoming site plan.
Summary
In accordance with Section 21-302.2, the proposed lot has been pinned. Once the conditions of approval have been met, the replat will conform with the Zoning Ordinance and Subdivision Regulations.
