ORDINANCE NO. 8051
AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS RELATED TO THE FINES AND COURT COSTS ASSESSED UPON CONVICTION OF A TRAFFIC VIOLATION IN MUNICIPAL COURT.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
Section 1. Section 1-113 of the Code of the City of Lawrence, Kansas, 2006 Edition is hereby repealed.
Section 2. Section 17-102.1 of the Code of the City of Lawrence, Kansas, 2006 Edition is amended to read as follows:
17-102.1 PENALTY FOR SCHEDULED FINES.
The fine for violation
of an ordinance traffic infraction or any other traffic offense for which the
Municipal Judge establishes a fine in a fine schedule shall not be less than $60.00
$68.00 nor more than $100 except for:
(A)
defective equipment
violations which shall be $30.00 $38.00 and
(B) speeding infractions which shall be according to the following schedule:

|
A person tried and convicted for violation of an ordinance traffic infraction or other traffic offense for which a fine has been established in a schedule of fines shall pay a fine fixed by the court not to exceed $1000.00.
Section 3. Section 17-116.3 of the Code of the City of Lawrence, Kansas, 2006 Edition is hereby amended to read as follows:
17-116.3 Ordinance Traffic Infraction; $60.00 Minimum
Fine.
Any person who violates
the provisions of this ordinance shall, upon conviction, be guilty of an
ordinance traffic infraction and shall be fined a minimum of $60.00
$68.00. Each violation of this section shall constitute a separate
offense and shall be punishable as a separate offense.
Section 4. Section 17-217.3 of the Code of the City of Lawrence, 2006 Edition is amended to read as follows:
17-217.3 SAME; PENALTY PROVISION.
Violation of this
ordinance shall be considered a parking infraction, and upon conviction the
violator shall receive a fine of not less than $30 $40 nor
more than $100.
Section 5. Section 17-420 of the Code of the City of Lawrence, Kansas, 2006 Edition, is hereby amended to read as follows:
17-420 VEHICLE PARKING VIOLATIONS; PENALTIES
Any person violating any
of the provisions of this Article shall upon conviction receive a fine of not
less than $30 $40.
Section 6. Section 17-603 of the Code of the City of Lawrence, Kansas 2006 Edition, is hereby amended to read as follows:
17-603 PENALTY.
Any person violating any
provisions of the Article shall be deemed guilty of a misdemeanor and upon
conviction thereof, shall be fined in a sum of not less than $60.00 $68.00,
or by imprisonment in jail for not less than one day nor more than
thirty (30) days, or by both such fine and imprisonment.
Section 7. Severability. If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.
Section 8. Repeal of Prior Law. All previous versions of the sections of the Code of the City of Lawrence, Kansas amended in this ordinance are hereby repealed.
Section 9. Effective Date. This ordinance shall take effect and be in full force and effect following its adoption and publication as provided by law.
