ITEM NO. 2:  FINAL PLAT FOR VAN GO MOBILE ARTS ADDITION; 715 NEW JERSEY STREET (JCR)           

 

PF-09-27-06: Final Plat for Van Go Mobile Arts Addition. This proposed 1 lot subdivision contains approximately .613 acres. The property is located at 715 New Jersey. Submitted by Landplan Engineering, PA, for Van Go Mobile Arts, Inc., property owner of record.

 

STAFF RECOMMENDATION: Staff recommends approval of the Final Plat for Van Go Mobile Arts Addition and forwarding it to the City Commission for acceptance of easements, subject to the following conditions:

1.      Revise the face of the plat to show the following:

a.      An expanded area for the public sidewalk and utility easement to include the area of the existing municipal water line.

b.      Tract acquired from BNSF Railway Company should reference Recorded Book Number 1011, Page 342, please revise.

2.      Submittal of a revised Master Street Tree Plan.

3.      Provision of an Agreement Not to Protest the Formation of a Benefit District for sidewalk improvements to E. 7th Street.

4.      Provision of the following fees and documentation:

a.               Recording fees made payable to the Douglas County Register of Deeds;

b.               A Temporary Utility Agreement

 

 

Reason for Request:

To create one platted lot from portions of six existing platted lots for the redevelopment of the site to house Van Go Mobile Arts workshop and small retail area/gallery.

GENERAL INFORMATION

Current Zoning and Land Use:              IG (General Industrial District) vacant industrial/warehouse structure and gravel parking lot.

 

Surrounding Zoning and Land Use:    IG (General Industrial District) to the north and east; train depot, railroad and industrial uses.

 

RM24 (Multi-Dwelling Residential District) to the south and west; residential uses.

Zoning and Land Use

This site is zoned IG (General Industrial) and is home to an art workshop and a small associated retail art gallery.  These uses are classified as Limited Manufacturing and Production which is a permitted use category in the IG District, subject to an approved site plan.  The proposed lot meets all area and width requirements.

 

In anticipation of the redevelopment of this site, Van Go Mobile Arts, Inc. has purchased portions of Lots 1 and 3, all of Lots 5-9, and the north half of Lot 11 and is replatting these lots to create one lot, described on the plat as Lot 1.

 

Infrastructure

Existing municipal water, sanitary sewer and storm sewer infrastructure is available to service this property.

 

Easements

A 12’ wide pedestrian and utility easement has been provided along the northeast property line for the placement of a public sidewalk.  An 8” municipal water line currently exists within the area of this proposed easement, which runs parallel to 7th Street in private property.  An additional 12” municipal water line also exists running parallel to 7th Street beyond the boundaries of the proposed pedestrian and utility easement.  The proposed 12’ wide pedestrian and utility easement should be widened to approximately 18’ in width to accommodate both municipal water lines.

 

Conformance

This plat request conforms with all applicable regulations and standards of the Subdivision Regulations and the Development Code.

 

Summary

The applicant is requesting to create one platted lot from all of or portions of Lots 1, 3, 5, 7, 9 and 11, with the exception of those portions of Lots 1 and 3 that include 7th Street and the south half of Lot 11.
