ITEM NO. 1:                                                  FINAL PLAT FOR MIRACON PLAZA; NE CORNER OF CLINTON PKWY & WAKARUSA DR (LAP)

 

PF-08-22-06:  Final Plat for                   PF-09-26-06:  Final Plat for Miracon Plaza. The three-lot commercial and office project is located on the NE corner of Clinton Parkway and Wakarusa Drive. Submitted by Landplan Engineering, PA, for Timothy W. Schmidt, property owner of record.

 

STAFF RECOMMENDATION: Planning staff recommends approval of the Final Plat for the Miracon Plaza and forwarding it to the City Commission for acceptance of easements and rights-of-way, subject to the following conditions:

1.      Provision of the following fees and documentation:

a)         A current copy of a paid property tax receipt.

b)         Recording fees made payable to the Douglas County Register of Deeds.

c)         A completed Master Street Tree Plan in accordance with Section 21-708a.3.

d)         A Temporary Utility Agreement.

2.      Submittal of public improvement plans for water, sanitary sewer, and stormwater mains, and Wakarusa Drive improvements, including sidewalks and associated required geometric improvements.

 

Reason for Request:

To replat a one-lot property into three lots for the development of an office/commercial complex that is consistent with a recently-approved Preliminary Development Plan.

 

KEY POINTS

·         The Miracon Plaza Addition Final Plat includes three lots.

·         The subject property is currently platted as the one-lot Stoneridge Plaza.

·         A Preliminary Development Plan, which also serves as a Preliminary Plat, was approved by the City Commission on August 15, 2006.

 

ASSOCIATED CASES/OTHER ACTION REQUIRED

·         Z-01-02-06: A request to rezone a tract of land approximately 5.05 acres from PCD-2 (Planned Commercial Development) District to PCD-2 (Planned Commercial Development) District (with additional allowable uses). This application was recommended for denial by the Planning Commission on 3/13/06 and denied by the City Commission on 5/2/06.

·         PDP-01-03-06: Revised Preliminary Development Plan for Miracon Plaza. This application was recommended for approval by the Planning Commission on 7/26/06 and was approved by the City Commission on 8/15/06.

·         Acceptance of easements and rights-of-way by the City Commission.

·         Recordation of the final plat at the Register of Deeds Office.

·         Submittal and approval of a Final Development Plan for Miracon Plaza.

 

 

 

GENERAL INFORMATION

Current Zoning and Land Use:

PCD [Stoneridge Plaza] (Planned Unit Development) (formerly PCD-2) District with limited uses; undeveloped land.

 

Surrounding Zoning and Land Use:

RMO (Multi-Dwelling Residential-Office) (formerly RO-1) District to the north; residential duplexes.

 

PRD [Parkway Apartments] (Planned Unit Development) and PCD [Wakarusa Center] (Planned Unit Development) (formerly PRD-2 and PCD-2) Districts to the south and west; multi-family residences and commercial uses, respectively.

 

RS7 (Single-Dwelling Residential) (formerly RS-2) District to the east; single-family residences.

STAFF REVIEW

The applicant is requesting final plat approval of Miracon Plaza Addition, which is a three-lot plat. The approved Miracon Plaza Preliminary Development Plan includes 23,300 gross square feet of commercial and office space, with 12,700 square feet of dedicated commercial space. The site is located on the northeast corner of Wakarusa Drive and Clinton Parkway.

 

Street Rights-of-Way

No new rights-of-way are being dedicated for Wakarusa Drive or Clinton Parkway, as the existing rights-of-way are sufficient to meet the minimum requirement for principal arterials within the City limits. Proposed modifications to Wakarusa Drive include the widening of the roadway, reconstruction of the median, geometric lane improvements, and reconstruction of the sidewalk abutting the subject property to a minimum of six feet wide.

 

Sidewalks

The sidewalk along Wakarusa Drive is proposed for reconstruction in order to meet City standards for a 6-foot wide sidewalk along an arterial. A portion of this sidewalk will be located outside the City right-of-way, and will be placed with a 15-foot wide combined utility and pedestrian easement. An 8-foot wide sidewalk exists along Clinton Parkway abutting the site.

 

Water/Sanitary Sewer/Stormwater Services

Existing waterlines abut the property along Wakarusa Drive and Clinton Parkway. Waterline plans will need to be submitted for review and approval from the Fire and Utilities Departments before building permits are issued.

 

Sanitary sewer mains run north-south and east-west within the southeastern portion of the site. A Downstream Sanitary Sewer Study has been approved by the City’s Utilities Engineer.

A storm stream runs north-south along the eastern side of the property. A large drainage easement accommodates this storm stream and a detention area. A note has been included on the plan, stating: “The detention area will be privately-owned and maintained. The developer is responsible for establishing ownership and maintenance of the detention area via individual owner maintenance”. A Drainage Study has been approved by the City’s Stormwater Engineer.

 

Public improvement plans will be submitted for water, sanitary sewer, and stormwater mains, and Wakarusa Drive improvements, including sidewalks and associated required geometric improvements, prior to recordation of the final plat at the Register of Deeds’ Office.

 

Easements

The subject property was previously platted in 1998 and, therefore, includes some existing utility and drainage easements. New access easements will be dedicated to accommodate cross access between the three lots, while new combined pedestrian/utility and utility easements will be dedicated for the new sidewalk along Wakarusa Drive and site utilities.

 

Conformance

The subject property is zoned PCD [Stoneridge Plaza] (Planned Unit Development) (previously PCD-2) District with limited uses. As the Preliminary Development Plan and rezoning applications were reviewed under the City’s previous zoning regulations, the lots were reviewed for their conformance with the previous area and dimensional standards. The new lot meets the minimum lot area and dimensional requirements for Planned Commercial Districts.

 

Summary

Once the conditions of approval have been met, the final plat will conform with the Zoning Ordinance and Subdivision Regulations.
