ORDINANCE NO.  8049

 

 

AN ORDINANCE ENACTING ARTICLE 15 OF CHAPTER VI OF THE CODE OF THE CITY OF LAWRENCE, KANSAS 2003 EDITION PERTAINING TO CHRISTMAS TREE SALES

 

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

Section 1: Article 15 of Chapter VI is herby enacted to the Code of the City of Lawrence, Kansas 2003 Edition and shall read as follows:

 

“Article 15 Christmas Tree Sales

 

6-1501 Permit Required for Selling.

No Christmas tree may be sold within the city except after issuance of a permit as provided in this Article.  A fee of ten dollars ($10.00) shall be charged for such permit. Each permit will be valid for forty-five (45) continuous days and will expire on December 31st of each calendar year. 

 

 

6-1502 Issuance of Permit - Zones Allowed.

The City Clerk shall issue permits for the sale of Christmas trees, provided the sites for which applications are made are zoned for one of the following uses:  Neighborhood Commercial Center District (CN2), Community Commercial Centers District (CC), Regional Commercial District (CR), Commercial Strip District (CS), Planned Commercial District (PCD), Limited Industrial District (IL), and General Industrial District (IG). Before issuing any such permits, the city clerk shall determine whether adequate parking is available for the respective sites.

 

6-1503 Sales in other than designated zones.

Applications to sell Christmas trees at locations which are zoned other than as mentioned in 15-602 may be granted by the governing body upon such terms and conditions as may be imposed.”

 

 

Section Two: This ordinance shall take affect and be in force from and after its passage and publication as provided by law.
