Christmas Tree Sales Ordinance

 

Staff is proposing enacting a Christmas Tree Sales ordinance to allow the city to regulate the location and time frame of Christmas tree sales in the City.  The previous City ordinance regulating Christmas tree sales was not included in the adoption of the new Land Development Code and the proposed ordinance will remedy the omission.

 

This will be an administrative ordinance as part of Chapter VI, Business Licenses, Taxes and Regulations and is consistent with what the City of Lawrence has done in the past with regard to the permit fee (ten dollars) and the zoning locations where Christmas tree sales will be allowed (Neighborhood Commercial Center District (CN2), Community Commercial Centers District (CC), Regional Commercial District (CR), Commercial Strip District (CS), Planned Commercial District (PCD), Limited Industrial District (IL), and General Industrial District (IG)).    The permit will now be issued by the City Clerk’s office instead of the Planning Department.   The ordinance is modeled after the City of Overland Park’s Christmas Tree Sales Ordinance. 

 

Staff recommends approving the ordinance. The proposed ordinance is attached.
