ITEM NO. 1B:           FINAL PLAT FOR JOYCE ADDITION; 912 N. IOWA ST (JCR)         

 

PF-08-20-06: Final Plat for Joyce Addition. This proposed plat contains approximately .977 acres. The property is generally described as being located at 912 N. Iowa Street. Submitted by Dean Grob of Grob Engineering Services for John J. Joyce III, property owner of record.

 

STAFF RECOMMENDATION: Staff recommends approval of the Final Plat for Joyce Addition and forwarding it to the City Commission for acceptance of easements and right-of-way, subject to the following conditions:

1.      Provision of the following fees and documentation:

a.               A current copy of a paid property tax receipt;

b.               Recording fees made payable to the Douglas County Register of Deeds;

c.                A Temporary Utility Agreement

 

 

Reason for Request:

To create a platted lot for future construction of office/warehouse uses.

GENERAL INFORMATION

Current Zoning and Land Use:           RS-10 (Single-Dwelling Residential District – 10,000 square feet)’ currently vacant, original residence has been razed.

 

Surrounding Zoning and Land Use:   A (Agricultural District) to the south; residential dwelling and agricultural uses.

 

IG (General Industrial District) to the west and north; Del Monte Corporation, manufacturer; Riverside Business Park, office/warehouse uses.

 

A1 (Suburban Home Residential District) to the east; Residential dwellings.

STAFF REVIEW

The subject property is located at 912 North Iowa Street, north of Interstate 70/Kansas Turnpike.  The following applications are also being considered with the final plat application: a preliminary plat (PP-08-13-06) and a site plan (SP-06-51-06).  Upon approval of the preliminary and final plats, staff may administratively approve the site plan.

 

Zoning and Land Use

The property owner was granted a rezoning of the subject property from RS-1 Single-Family Residential to M-2 General Industrial by the City Commission on September 17, 2004 on the condition that a final approved plat be filed with the Register of Deeds.  The rezoning ordinance is awaiting approval of this final plat before being published.  Based upon the new Development Code, this property will be zoned IG, General Industrial.

 

Street Right-of-Way

The City has requested and the applicant has agreed to grant 17 feet of additional right-of-way for North Iowa Street along the front of the subject lot.  North Iowa Street is classified as a minor arterial road which according to current Subdivision Regulations, requires a minimum of 80 total feet of right-of-way.  The additional 17 feet will make for a total of 50 feet of right-of-way east of centerline and 100 feet for the entire right-of-way.

 

Infrastructure

Proposed plat has been reviewed by Municipal Utilities, Stormwater, and the Public Works Departments for compliance with all applicable master plans.  No public improvements are required to be constructed as part of the final plat.  A sidewalk will be required along Iowa Street, however this public improvement will be addressed with the pending site plan that is currently being reviewed administratively.

 

Easements

The preliminary plat shows several utility easements.  An existing 15’ wide utility easement exists along the inside of the east property line and 7.5’ wide utility easements are proposed along the inside of both the north and south property lines.  A 10’ wide utility easement is proposed inside the west property line adjacent to an existing 25’ wide KP&L easement.  The KP&L easement will straddle the new west property line with approximately 15’ being outside the property within the right-of-way and 10’ inside the property. That portion of the exclusive KP&L easement that will lie within the right-of-way will result in the right-of-way being encumbered.  This issue is addressed with the granting of the new 10’ wide utility easement immediately adjacent to the KP&L easement lying inside the property.  This situation also arose with the platting of Northfield Estates to the south and was resolved in the same manner as is proposed here.

 

Conformance

The lot in this proposed plat meets the width and area requirements of the IG, General Industrial District as well as the requirements of the Subdivision Regulations.  The lot corners have been pinned.

 

 

Summary

This lot will take access to North Iowa Street, a minor arterial road.  The owner has razed the original buildings and has submitted a site plan showing two office/warehouse structures for administrative review and approval.  The site plan cannot be approved until the final plat is approved and the zoning ordinance published.  A Master Street Tree Plan has been provided and will be reviewed during site plan review.  Additionally, a Stormwater Pollution Prevention Plan (SWP3) will be required to be submitted and approved prior to site plan approval.  While site plan review and approval is an administrative function, approval may only be granted following the approval of this plat and publication of the associated rezoning ordinance.  A specific access location will be determined through the site plan review process.

 

Recommendation: Planning Staff recommends approval of the final plat and forwarding to the City Commission for acceptance of easements and rights-of-way subject to the following conditions:

b.               Recording fees made payable to the Douglas County Register of Deeds; and
