PF-07-18-06: Stephens-Noller Addition; SW Corner of Research Park Drive and Bob Billings Parkway.

 

The Stephens-Noller Addition is a proposed one-lot subdivision for office development containing approximately 2.678 acres in the IBP (Industrial Business Park) District. On August 23, 2006 the Lawrence-Douglas County Planning Commission voted unanimously to recommend approval of the Stephens-Noller Final Plat and forwarded it to the City Commission for acceptance of easements and rights-of-way. The City Commission accepted the dedication of easements and rights-of-way as part of the September 5, 2006 consent agenda.

 

The applicant is proposing a minor revision to the easements on this final plat which has not yet been recorded with the Douglas County Register of Deeds. This final plat is therefore being brought back to the City Commission for acceptance of the revised easements.

 

A shared detention pond is proposed to serve this lot and the lot to the west, (Lot 1, Block One of Bobwhite Addition) rather than the small detention pond which was originally planned for this property. A drainage easement is necessary for a shared detention pond and the City Subdivision Regulations require that drainage easements be separate from the dedication of other utility easements (Section 21-609).  The Stephens-Noller Final Plat has been revised to include the drainage easement for the shared detention pond and has removed the conflicting utility easements.

 

Staff recommends that the City Commission accept the dedication of the rights-of-way and easements of this revised final plat subject to the conditions of approval of the original plat with one additional condition relating to this revision. The conditions of approval are below, with the new condition in bold print:

 

1.           Provision of a revised Final Plat with the following changes:

a.       Cross access easement shown from the access point on Research Park Drive consistent with the proposed site plan layout.

b.       Note added stating that the drainage easement will be privately owned and maintained.

2.           Execution of a Temporary Utility Agreement;

3.           Provision of the following fees and recording documentation:

a.      Copy of paid property tax receipt;

b.      Recording fees made payable to the Douglas County Register of Deeds;

c.       Completed Master Street Tree Plan.
