Purchase of Easements: Pump Station No. 48 Project

On September 5, 2006, the City Commission authorized purchase of approximately 44 acres south of the KTA and north of N 1175 Road and north of Martin Park for the location of the Baldwin Creek Pump Station. Additional property acquisition, primarily sanitary sewer easements and temporary construction access and staging areas are required throughout the remainder of the project alignment – (see attached project map). On October 10, 2006, the final contract to the design build team of CAS Construction/PEC Engineering was awarded. Mobilization for this project has already begun and the property acquisition team is continuing its efforts to obtain all the necessary property interests for the project.
The City will need a 100 foot temporary construction easement which will convert to a 40’ permanent sanitary sewer easement (on Douglas County Plate No. 800099) Douglas County Plate No. 800108A) easement – for a total of approximately 108,150 sq. ft – 2.5 acres of permanent easement. These properties are owned by Elizabeth Spray Haehl, trustee of the Alice C. Spray Credit Trust. These tracts are north of the pump station site and north of the Kansas Turnpike. Temporary construction easement areas amount to 3.7 acres.
The City engaged Keller & Associates to advise the City on the fair market value of the property. The property owner has accepted the appraised offer and the property acquisition team for the project recommends the acquisition of the needed permanent and temporary easements in the total amount of $33,500.
The City will need a 100 foot temporary construction easement of 82,198 sq. ft (which will convert to a 40’ permanent sanitary sewer easement (on Douglas County Plate No. 800089B01) for a total of approximately 54,798 sq. ft – 1.25 acres of permanent easement. This property is owned by Janette McCullough, trustee of the Janette McCullough Living Trust. This tract is directly north of the City owned property purchased from the Dickey brothers in 2001. An offer to the property owner for the needed easements was made based on the City’s acquisition costs for the Dickey property and was accepted in the amount of $17,900.
Action Requested
Authorize the City Manager to execute a purchase agreement for the above described easements from Elizabeth Spray Haehl, trustee of the Alice C. Spray Credit Trust, in the total amount of $33,500 and to execute a purchase agreement from Janette McCullough, trustee of the Janette McCullough Living Trust in the amount of $17,900.
Project Funding
Initial funding for this acquisition will come from the Utilities Dept. capital improvement reserve fund. Funding for this project will ultimately be shared by the City at large and by development benefiting from this infrastructure improvement through the payment of special connection charges pursuant to Ordinance 8043.
