ORDINANCE NO. 7999

 

AN ORDINANCE PROVIDING FOR THE REZONING OF 12.329 ACRES FROM I-1 (LIMITED INDUSTRIAL) DISTRICT AND A (AGRICULTURAL) DISTRICT TO RM24 (MULTI-DWELLING RESIDENTIAL) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 1, SECTION 108, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2006 EDITION,” AND AMENDMENTS THERETO.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on January 23, 2006, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from I-1 (Limited Industrial) District and A (Agricultural) District to RM-2 (Multiple-Family Residential) District; and

 

WHEREAS, the zoning recommendation came before the governing body of the City of Lawrence, Kansas on February 21, 2006, and after due consideration and deliberation the recommended zoning change was authorized; and

 

WHEREAS, the Governing Body of the City of Lawrence, Kansas did on April 4, 2006, adopt Ordinance No. 7985, adopting the Development Code of the City of Lawrence, Kansas, (hereinafter “the Development Code”) effective July 1, 2006; and

 

WHEREAS, the Governing Body of the City of Lawrence, Kansas did on April 4, 2006, adopt Ordinance No. 7986, adopting the Official Zoning District Map for the Development Code of the City of Lawrence, Kansas, effective July 1, 2006; and

 

WHEREAS, pursuant to Section 20-110 (e) of the Development Code, the Official Zoning District Map designations in effect before the effective date of the Development Code convert to New Map Designations set forth in the table in Section 20-110 (e); and

 

WHEREAS, pursuant to Section 20-110 (e) of the Development Code, the RM-2 designation has converted to Multi-Dwelling Residential District, RM24 designation.

 

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.


 

SECTION II.  That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:

                                                 

A TRACT OF LAND IN THE NORTHWEST QUARTER OF SECTION 9, TOWNSHIP 13 SOUTH, RANGE 20 EAST OF THE 6TH P.M. IN DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:

 

COMMENCING AT THE NORTHWEST CORNER OF SAID NORTHWEST QUARTER; THENCE NORTH 88°53'29" EAST, ALONG THE NORTH LINE OF SAID NORTHWEST QUARTER, A DISTANCE OF 985.90 FEET; THENCE SOUTH 01°10'34" EAST, 445.56 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE SOUTH 01°10'34" EAST, 834.66 FEET; THENCE NORTH 88°52'57" EAST, 674.19 FEET; THENCE NORTH 01°31'40" WEST, 502.42 FEET; THENCE ALONG A CURVE TO THE LEFT, 524.16 FEET, SAID CURVE HAS A RADIUS OF 335.00 FEET AND A CHORD BEARING NORTH 46°21'07" WEST, 472.31 FEET; THENCE SOUTH 88°49'26" WEST, 336.11 FEET TO THE POINT OF BEGINNING. CONTAINING 537,067 SQUARE FEET OR 12.329 ACRES, MORE OR LESS.

 

be and the same is hereby changed from that of I-1 (Limited Industrial) District and A (Agricultural) District to RM24 (Multi-Dwelling Residential) District, as such district is defined and prescribed in the Development Code of the City of Lawrence, Kansas, effective July 1, 2006, and amendments thereto;

 

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 1, Section 108, of the “Code of the City of Lawrence, Kansas, 2006,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

SECTION IV.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
