Dear Mr. Maxwell:

The Lawrence Historic Resources Commission (HRC) at their meeting on September 21, 2006, did not approve the above-referenced request.  The HRC determined that the project, as proposed, does not meet the established standards and guidelines for the rezoning of structures located in the environs of a property listed on the National Register of Historic Places.

 

In accordance with the Standards and Guidelines for Evaluating the Effect of Projects on Environs, the standard of evaluation, the proposed project does not meet Standards 1, 2, and 3, and will encroach upon, damage or destroy the listed historic property and its environs.  

 

1.       The character of a historic property’s environs should be retained and preserved.  The removal or alteration of distinctive buildings. Structures, landscape features, spatial relationships, etc. that characterize the environs should be avoided.

 

2.       The environs of a property should be used as it has historically been used or allow the inclusion of new used that require minimal change to the environs’ distinctive materials, features, and spatial relationships.

 

3.       The environs of each property will be recognized as a physical record of its time, place, and use.  Changes to the environs that have acquired historic significance in their own right should be retained and preserved.

 

As indicated at the HRC meeting, we encourage you to work with staff to revise your project so that it meets the identified standards and guidelines while achieving your desired project goals. You may appeal the Historic Resources Commission determination per K.S.A. 75-2724.  If you wish to appeal the HRC determination, you will need to request a public hearing before the City Commission.  Please contact me if you wish to appeal this decision and I will make sure you have the appropriate information.
