RE: DR-06-63-06; 917 Delaware; Rezoning

Dear Mr. Maxwell:

The Lawrence Historic Resources Commission (HRC) at their meeting on September 21, 2006, did not approve the above-referenced request.  The HRC determined that the project, as proposed, does not meet the established standards and guidelines for the rezoning of structures located in the environs of a property listed on the National Register of Historic Places.

 

In accordance with the Standards and Guidelines for Evaluating the Effect of Projects on Environs, the standard of evaluation, the proposed project does encroach upon, damage, or destroy any listed historic property or its environs, specifically:

 

1.      The rezoning request does not continue the histories land use in the environs of the listed property.

2.      Currently, there is no mitigation document for the adverse effects of the requested rezoning.

3.      Currently there is no design document indicating the compatibility of the proposed new use.

 

As indicated at the HRC meeting, we encourage you to work with staff to revise your project so that it meets the identified standards and guidelines while achieving your desired project goals. You may appeal the Historic Resources Commission determination per K.S.A. 75-2724.  If you wish to appeal the HRC determination, you will need to request a public hearing before the City Commission.  Please contact me if you wish to appeal this decision and I will make sure you have the appropriate information.
