ITEM NO. 17:           TEXT AMENDMENT TO CHAPTER 20 DEVELOPMENT CODE (SMS)

TA-06-04-06:  Consider adoption of revisions to Chapter 20, Development Code to correct inconsistencies since adopted.  Initiated by the Planning Commission at the July 26 meeting.

STAFF PRESENTATION

Staff recommended the Planning Commission forward a recommendation for approval of the proposed revisions [TA-06-04-06] to Articles 2, 4, 5, 9, 13, 14 & 17 of the “Development Code, July 1, 2006 Edition,” to the City Commission. 

Amendments identified in the staff report are to the following sub-sections: 108(a); 110 (e); 201 (b); 205(g)(3); 207(d); 208(d); 209(d); 212(d); 213(d); 214(e); 302(i)(6); 302(k); 304; 402; 403; 537(5)(ii) 901(b)(1); 1305(a); 1305(c)(1); 1305(c)(5); 1402(f); 1701; 1725. Planning Staff did not recommend a change to the definition of ‘owner’ currently in the Development Code nor the addition of a definition of the term ‘occupant’.

STAFF CLOSING COMMENTS

Staff had no closing comments.

COMMISSION DISCUSSION

Commissioner Burress asked staff if the definition of “owner” or “occupant” had actually been a problem or was it only a theoretical problem to this point. Stogsdill replied that she was not aware of it being a problem and that it was just theoretical.

ACTION TAKEN

Motion by Commissioner Harris, seconded by Commissioner Finkeldei, to recommend approval and forward to City Commission based on the findings of fact presented in the body of the Staff Report.

Motion carried unanimously, 10-0.
