Purchase of Easements: Pump Station No. 48 Project

On September 5, 2006, the City Commission authorized purchase of approximately 44 acres south of the KTA and north of N 1175 Road and north of Martin Park for the location of the Baldwin Creek Pump Station. Additional property acquisition, primarily sanitary sewer easements and temporary construction access and staging areas are required throughout the remainder of the project alignment – (see attached project map).
The City will need a 100 foot temporary construction easement which will convert to a 40’ permanent sanitary sewer easement (approximately 94,089 sq. ft – 2.16 acres) on property owned by Roger and Russell Tuckel. This tract is directly north of the pump station site and north of the KTA (Douglas County Plate No. 800101A02). Additional temporary contractor access, construction, storage and staging areas are also needed totaling approximately 4.0 acres (map).
The City engaged Keller & Associates to advise the City on the fair market value of the property, and the property acquisition team for the project recommends the acquisition of the needed permanent and temporary easements in the total amount of $25,000.
Easements will also be required on properties within the Bauer Farms Estates. The City will need a 100 foot temporary construction easement which will convert to a 40’ permanent sanitary sewer easement on Lot 1, Block 1 of Bauer Brook Estates No. 3 (approximately 36,923 sq. ft) and an additional temporary storage and contractor access area (approximately 11,137 sq. ft) on property owned by Lawrence & Carrie Sinks – located at the southeast corner of the Bauer Brook Estates (map).
The City engaged Mark Boettcher of Appraisal Dynamics to advise the City on the fair market value of the acquisition. The property owners have accepted the appraised offer of compensation for the temporary and permanent easements in the total amount of $15,439.
Action Requested
Authorize the Interim City Manager to execute a purchase agreement for the above described easements from Roger and Russell Tuckel in the total amount of $25,000 and a purchase agreement from Lawrence and Carrie Sinks in the total amount of $15,439.
Project Funding
Initial funding for this acquisition will come from the Utilities Dept. capital improvement reserve fund. Funding for this project will ultimately be shared by the City at large and by development benefiting from this infrastructure improvement through the payment of special connection charges.
