Attached is Resolution No. 6677 authorizing an ordinance and the exercise of eminent domain proceedings to acquire property interests for the line easements necessary for the Baldwin Creek Pump Station #48 project.  Also attached is Ordinance 8042 which would be published after City Commission action.  The condemnation would be filed after publication.

The purchase of the pump station site and a significant portion of line easements have been negotiated with Russ and Roger Tuckel.  Acquisition is set to close after City approval of the contracts.  Construction of the pump station and portions of the lines into and out of the station will be able to begin immediately with this purchase.

Offer letters have been sent and active negotiations are underway to acquire easements along the rest of the line routes.  It is anticipated that most of the property interests will be able to be acquired through negotiations over the next 4-6 weeks.  However, in order to insure that property is under control for timely construction of the project, it is necessary to initiate condemnation proceedings now.  Property owners are aware that this will occur and that it should not result in any expense to them unless a negotiated easement purchase cannot be agreed upon in the next month or so.

We request that these two items be place on the City Commission agenda Tuesday, October 11 so the project can maintain its aggressive schedule.
