Temporary Sale, Possession and Consumption of Alcoholic Beverages at Burcham Park for Darfur Fundraiser on September 30th

Ryan Davis a student at the University of Kansas is planning a benefit concert event to raise funds for, and provide information about, the victims of genocide in Darfur, Sudan, Africa. Mr. Davis has received a Special Use Permit from Parks & Recreation and has reserved Burcham Park for the September 30th event. He is requesting permission to allow the sale, possession and consumption of alcoholic liquor at Burcham Park from noon to 10:00 p.m. Mr. Davis has also applied for a temporary permit with both Alcohol Beverage Control and our office in order to sell alcoholic beverages at the event.
The possession and consumption of alcoholic beverages on city property is prohibited by City Code. However, City Code section 4-105(E) allows the City to exempt, by ordinance, specified City property from the prohibition of alcoholic beverages on public property. Therefore, an ordinance allowing the temporary sale, possession and consumption is required. As such, I have attached a copy of Ordinance 8038 for the Commission’s consideration. This ordinance authorizes the sale, possession and consumption of alcoholic beverages on September 30, 2006 in Burcham Park from noon to 10:00 p.m.
