Sale, Possession and Consumption of Alcohol Beverages on East 8th Street for the Chamber of Commerce “Get Downtown” Event

 

 

Staff has recently received a request from Free State Brewing Co. to allow alcoholic beverages on East 8th Street between Massachusetts and New Hampshire Streets in connection with the Lawrence Chamber of Commerce’s “Get Downtown” musical event.  On the August 29th Consent Agenda, the City Commission approved the use of that portion of East 8th Street for the event and Free State Brewing Co. is requesting approval to sell, possess, and consume alcoholic beverages in that portion of 8th Street on October 6th between the hours of 6:00 p.m. and 11:00 p.m.  Free State Brewing Co. has also applied for a temporary permit with both the Alcohol Beverage Control Bureau of the Kansas Department of Revenue and our office in order to sell alcoholic beverages at the event.

 

The possession and consumption of alcoholic beverages on City property is prohibited by City Code.  However, section 4-105(E) of the City Code allows the City Commission to exempt, by ordinance, specified City property from the prohibition of alcoholic beverages on public property.  Therefore, an ordinance allowing the temporary sale, possession and consumption is required.  I have attached a copy of Ordinance No. 8033 for the Commission’s consideration.  This ordinance authorizes the sale, possession and consumption of alcoholic beverages on October 6, 2006 on East 8th Street between Massachusetts and New Hampshire Streets between the hours of 6:00 p.m. and 11:00 p.m.
