RE:	License Agreement – KU Alumni Association September 5, 2006 Agenda Item

Presented for City Commission consideration is a License Agreement for the KU Alumni Association to place a sign in the right-of-way approximately 14’ west of their property line at 1266 Oread. Placement of this sign would be in keeping with already established entrances to KU facilities.

There are no concerns or conflicts with utilities, the historic environs, or Public Works. The proposed sign does not comply with the City of Lawrence Sign Code and is scheduled for a sign variance hearing on September 7, 2006 with the Sign Code Board of Appeals.

The license places all responsibility on the applicant for damage to utilities, responsibility to move if the sign is in the way, and neither the City nor other utilities are responsible for any damages to the sign if the utility were to cause damage in exercising their right/access/usage of the easement. The KU Alumni Association also agrees to indemnification of the City should a claim be pursued due to the applicant’s usage of the easement.

Action Requested: Approve License Agreement contingent upon approval by the Sign Code Board of Appeals.
