After discussions with the applicant and the Interim City Manager the conditions for Oregon Trail Addition have been modified. Condition No. 5 had originally stated that the plat could not be recorded until the Benefit District for George Williams Way had been successfully established. An agreement not to protest the creation of a benefit district has been determined to be adequate for this condition, given that the Benefit District for Stoneridge Drive has been established.

 

Accompanying this memo is the revised set of conditions for Oregon Trail Addition Final Plat.

ITEM NO.  3:              PRELIMINARY PLAT FOR Oread West No. 16, located on the southwest corner of Research Park and Legends Drive. (MKM)

 

PP-06-09-06:  Preliminary Plat for Oread West No. 16.  This proposed 4-lot industrial subdivision contains approximately 6.78 acres.  The property is generally described as being located on the southwest corner of Research Park and Legends Drive.  Submitted by Landplan Engineering, P.A., for Alvamar, Inc. Mabet #1 and Mabet #3, property owners of record. 

STAFF RECOMMENDATION:

Planning staff recommends approval of the variance requested for a reduction of minimum lot depth from 200’ to 165’.

Planning staff recommends approval of the Preliminary Plat based upon the findings of fact presented in the body of the Staff Report and subject to the following conditions:

1.      Provision of a revised plan with these changes:

a.       50’ building setback from Southern Star gasline must be shown.

b.      Plat must show the trees on site, and identify those which will be utilized with this development.

c.       If trees will be preserved, methods used for protection during construction must be listed on the plat.

d.      Indicate that the sidewalk will be repaired to City Standards.

e.       Note that states “Curb cuts shall be limited to shared access along adjacent property lines, or shall not occur less than 300 feet apart whichever is less.”

f.        A note must be placed on the plat stating that the detention ponds will be privately-owned and maintained by the property owner or owners. The developer is responsible for establishing ownership and maintenance of these detention areas via individual owner maintenance.
